I don't believe this...I have in my hand what the

VA has claimed does not exist...and even went so far as to lie to a United States Congressman about it. For the last 11 years the VA has denied the existence (claimed it was lost, whatever) of my request for an upgrade in disability. Somehow they evidently forgot remove this when I requested a complete copy of my C-File. I just received my C-File yesterday and not only does it contain my claim from 11 years ago, but it also contains all of their deniles of it's existence. And it clearly shows negligence on the part of the VA...and shows that they flat out lied to a US Congressman about it. Almost all of my medical records are missing from the file, but my claim (that they claimed did not exist) is right here in my hand!!!! Praise God!!! It looks like there is now a very good chance that they will have to back date my claim 11 years. I am going to push this as hard as I can. Praise God for this find!!!

    Generally speaking, the VA is a good deal for us. Sometimes though, the train will come off the tracks and sometimes, it takes a lot to get it back on the right track in the right direction.

    I have found that most of the folks at the VA are just plain great, do their best to do a good job for us bu then there are a few that go the other way.

    Guess they figured if congress can lie to them, they can lie right back at them.

    Now get some professional help -- the DAV, Legion, etc. and don't forget to get your congressman involved again. This is a "clear and unmistakeable error" on their part, and needs to be persued accordingly.

    A C U E is what they dread the most, because they can't win!

    Best wishes, positive thoughts, and prayers enroute. Had my own probs with the US Army- when I went from enlisted to comissioned, someone screwed up- and the enlisted me was listed as KIA, while the officer me was getting orders, getting paid, getting promoted, etc. As the man once said, would be damned funny if was not happening to ME! Turned out the underlying problem has to do with some clerk that swapped month/day on my date of birth, kicking record in limbo. Finally got straight last month- meaning I get credit for additional 4 years of service. Merry Christmas, Happy New Year, and GO GET 'EM!

    I would make an appointment to see my congressman, make copies, send a letter to the va, requesting an upgrade on your disabilities, telling them to backdate the increase in benefits to match your request.
    get a lawyer, file suit, that will make them sit up a take notice.
