Local Gunshop closed.

Story is..(unconfirmed..told by a friend of owner)
The Gunshop owners went to a LLC. The Batf sprung an inspection and shut them down..selling Firearms without a License.
They forgot to get a name change on the FFL.
Firearms were confiscated..owners told to get a lawyer..."Maybe will get them back..."

    An oversight like this should never be used to ruin a person's livelihood. They had an FFL and did not update it when they changed the business name? Predatory enforcement at it worst.

    The BATFE is a necessary evil given our current situation, but should still work with businesses toward a common goal of promoting business and enforcing the regulations that they are charged to enforce.

    This sort of 'gotcha' enforcement reveals a much more sinister goal.

    I think transfering to a LLC would require a "new" license.
    A phone call / letter (batfe response in writing) to batfe would have prevented any snafu.
    Thats why guys like Mateo make the big bucks..........

    Point being: The rules should never have been in place to begin with.

    What part of "Infringement" dont people understand???

    Was a time when a person could walk into sears and buy a gun as long as they were of legal age, and the law took care of those that used a gun in a wrongful manner.

    Now that there are 25000 plus laws on guns, things have gotten worse, not better and lawyers give the criminals excuses for their bad actions so most walk away with a slap on the wrist.[:(]

    Transferring to a llc is a little more than a name change, I believe it is a change of ownership / responsibility.

    Classic is spot on, here...The entire FFL setup is a direct violation of the Second Amendment..and most of those participating in it enjoy their protected status to do business without all those 'kitchen table" and 'trunk' dealers intefering with their profit margins.

    They do the Beasts' work for it..and there is no sympathy from me over another one being closed for paperwork violations.

    Perhaps if they were ALL closed...some of you gun owners would get as irritated as I over the steady loss of freedoms in this country.

    Probably not, tho..there is always Golf.

    I agree. They (BATF) didn't close,but pulled the FFL on a pawnshop that I did alot of business with as FFL receiver. Reportedly (shop owners story) over "questionable" paperwork violations. The shop owner, whom in my experience was VERY strict about following the law, (even made me write out State names instead of abbreviations) claims the agents came in w/a "we're out to get you" attitude and made mountains out molehills.

    Heh heh heh, as a "kitchen table dealer" I would like to know where these profit margins I am interfering with are.
    The feds shut down something like 80k 01 ffl's whith the passage of the 94 crime bill.

    The rule is Common knowledge....I didn't say it was a good rule but it is a freaking rule...
    I rarely wear my seatbelt when I get caught I pay the 75 klinkies and stfu...Why I know it is the law!!!
    Same with speeding...
    I support groups that see things my way... but bucking the system is stupid and does absolutely none of us any good!!!
    Take these guys that carry where the the law prohibits.. Yea they are right...But they are going about thing very wrongly and only hurting the rest of us...
    I can't see myself sticking for a guy that broke a rule that is common knowledge!!! In fact I'd probably move the dude to my IDIOT list...

    This was presented as basically a name change to the business. I.E. Fred's Pawn to Fred's Pawn, LLC. It in no way appears to be 'bucking the system', rather it is presented as a simple oversight. If that is the case, shutting them down is a gross over-reaction that is done maliciously. Agreeing with the law is not part of the conversation. Most agree that the law is too intrusive. Shutting down a business on a technicality is abuse of power.

    Incorporation, Type C, Sub. S or LLC should not be a Change in Ownership to begin with. It is a common business practice to shield the owners from the lawyers.

    If you think you understand all the rules of the ATF you are FOS. They can and will nail your butt to the wall and charge you with "hate Crimes" and RICO infractions if you give them the least chance to.

    Ask Compen and Raymos. Your Government loves you!

    Let me know when you get your 01 license, I have mine, and I inquired about transfering it to a LLC, the BATFE inspector I spoke with told me it would be the same as applying for a new license.
    I SPOKE TO THE BATFE ABOUT THIS YOUR INFORMATION COMES FROM WHERE?
