Please sticky - divorce rules
From time to time, I see members posting about their divorces. I also see replies that are meant to be helpful, but are really not. I deal with this stuff every day, so I want to lay a few things out there for everyone's benefit.
1. Whatever you write on the internet will be found.
2. Any website you go to will be looked at.
3. All responses to a post will be looked at.
4. 99% of the reason that I see divorces go bad (or worse) than they should be and are is due to the internet.
There is something that I see all the time on this board, and it is "you should take all your guns, sell them to your pal for $1.00, and get a receipt, and it's legit, and she can't get them. You'll get them back at the end". BS!!! What will happen is that any attorney with half a brain will see right through this, and the court will say "OK, smart guy, if all guns were worth $2500.00, she'll get $2,500.00 on top of whatever else she's getting". You will say "But they're only worth a dollar!! The Judge will say "Oh Really. Show me the $1.00 Kimber on Gun Broker." You will say "Well, they're really only worth $1,000.00." The Court will say "Fool me once, shame on you. Fool me twice, shame on me". You will have lost credibility with the judge and every time you go back, the other attorney will say "This is just like the gun sale...."
You will most likely end up with your guns. She doesn't want them. If she does, she only wants to hurt you, and the Court will see that as well.
Please be careful about posting how depressed you are, or that you want to kill her. Neither of these things will help you, and will cause you more grief than you are already going to get.
And really be careful about posting ways to get revenge. Even if not solicited. Even if its a joke. I reprsented a person who's spouse was a DJ. The DJ got on the air to talk about the divorce, and it turned into a call in show about ways to get revenge on the ex. My client called me about it, outraged, and I immediately fired off a subpoena to the station for the tapes. Before I even got the tapes, the other attorney called and caved in. Within a few weeks after that, the DJ was fired. I don't know if the issues were connected, but the bottom line is that it didn't help.
So, keep it holstered. You can ask for support, best wishes, etc. But free speech isn't free.....
