    Did you ask them to remove the charge? They always correct mistakes for me. If they did, you have no case. If they didn't, and you asked, then maybe you have a cival case, but only for the charges. Why would you try to go criminal charges on them over a disput? Criminal charges will hurt them, but it won't make you whole. Only cival charges will do that.

    It is funny, the banks made two mistakes, and both were in their own favor! How about that.
    I built a log house in Georgia and took out a mortgage on it. Any of you who have never bought a house, a mortgage closing is a 2 hour ordeal, you just sit there and sign about 25 legal documents that the lawyer shoves in front of your face. Half of them you don't read and wouldn't understand them if you did read them. Well, I noticed that the bank had put in that there would be one point charged to me. I had distinctly recalled that I had been told by the bank, more than once, there would be no points. This amounted to a $750 "mistake," and SURPRISE it was in the bank's favor.
    It was just me and the attorney at the closing, and she represented the bank. I got out my notes and showed that according to what I had been told over the phone, this was a $750 mistake. The lawyer didn't dispute that, but she said, "If we don't go ahead and close on this, I will have to send the paperwork back to Macon, and we won't be able to close for another week."
    I said, "I don't mind waiting another week. Make me wait 8 days, though, and I will find another bank."
    We closed in five days.

    You will never convince me that the mistake was not done on purpose. I also think the attorney knew about it, and she would have gotten a cut if she could have pulled it off.

    I made damn sure after that, whenever I did a real estate deal I would have my own attorney there to go over the paperwork.

    Just because they are a corporation and wear three piece suits doesn't mean they are not robbers.
    My girlfriend went around and around with Providian credit card company eight years ago, they tried to gyp her out of $3K. In the course of our battle with Providian we learned that they had to pay a $300 MILLION dollar fine to the feds because of their fraudulent practices.
    ps We did get our account straightened out but it took 10 months.

    Bingo, this is not about me I am worried that older people and people who do not look at their accounts once a week are being riped off.

    How many of you have been taken advantage of by your banks?

    Banks make most of their money on fees not the loans themselves.

    How many customers X 6.00 and how much money could that be?

    The question is this; they sent a false charge through the postal service. Over billing and mail fraud, I can't be the only one the banks are doing this too. What are the fines and prison terms for mail fraud?
