Parents Sue Hospital After Stillborn Baby's Body Sent to Cleaners

FORT WORTH, Texas - A couple are suing a hospital after their stillborn baby's body was sent with dirty laundry to the cleaners.
The Huguley Memorial Medical Center of Fort Worth staff took 19 hours to find the missing body, which was unpreserved and by then had been crushed and disfigured, according to the lawsuit filed Tuesday.
Kourtney McGee of Cleburne went to Huguley in July because she was bleeding in her second trimester, then gave birth to Jacob Dwayne Robinson. Staff told McGee and Milburn "Pete" Robinson of Alvarado, the baby's father, that the body would be taken the morgue.
But when the funeral director arrived, he was told the body could not be found. The baby's body was not refrigerated when it got to the morgue but instead was sent to a commercial cleaner with the laundry, according to the suit.
The lawsuit contends Huguley Memorial Medical Center breached its duty to care for, handle, maintain and/or prepare for burial. The lawsuit alleges negligence, which is the failure to extend ordinary care, and gross negligence, which shows either reckless conduct or conscious disregard for the family's rights.
The family has sustained "severe emotional distress and mental anguish" and seeks punitive and exemplary damages, according to the lawsuit that does not specify a monetary amount.
"How could this happen, that these parents lost their child, lost their son - then the hospital doesn't have a procedure or policy in place for dealing with it?" the couple's attorney John David Hart told the Fort Worth Star-Telegram.
Dallas attorney Michael Stewart, who is representing Huguley, denied the allegations and said the hospital did nothing inappropriate.
"Our sympathies go to a family obviously who had a stillborn situation. Everyone feels bad about that," Stewart said, declining to release more information because of the pending litigation.

when i first got into the courier business we moved medical specimens {i refused} but we got a call to pick up from one hospital to another the guy showed up, IT WAS A DEAD BABY for an autopsy, the guy took it, they called back and IT WAS THE WRONG DEAD BABY, so he went back, and they did a switcheroo

let me give a little different take on this.....a still born baby is not actually a baby. it was born dead. the "fetus" never lived outside of the womb which legally and medically means it was never a human being.
for the abortion advocates you will appreciate this.
this was never a human being. it was only a "clump of cells". when a woman has an abortion the "clump of cells" is considered medical waste and thrown in the garbage. Most hospitals incinerate the waste. No funerals. No burials. It is "trash".
The same would apply here. The "clump of cells" or "fetus" was born dead. Medically this is the same as an abortion. The "still born" was never alive and thus never a person.
I believe the hospital still should have honored the request of the parents but in reality the only thing they threw out was some physical matter belonging to the mother. Not a human being.0 -

Incorrect Civil Rights.
I worked on an OB Ward when we were still a hospital here. We had many miscarriages (spontaneous abortions), still births (both full term and premature).
Once the parents have decided to carry through to full term and delivery, it is not treated as "medical waste". Depending upon how far along the mother was, there will be an autopsy performed to help determine if there were underlying causes for the fetal death (drugs, alcohol, genetic, etc). The still born is presented to the parents in a receiving blanket if they so desire. Arrangements are then made with the family and their funeral director for either burial or cremation as is their wish. There are some parents that are so traumatized that they release the remains to the hospital and we then arrange for proper disposal.
From a medical standpoint, we were also required to photograph the fetus (again depending upon who far along) and make an entry into the ward logbook about the death or miscarriage.
The clinics that perform abortions do so only up to a certain point. After that predetermined time, the fetus is considered viable and an abortion will only be legally carried out to save the life of the mother.0 -
....moreover, the term "stillborn" implies not an embryo ("clump of cells"), but rather a fully formed neonate, or infant, dead prior to it's delivery. 0 -
