I agree. I would have to sit down with my tin foil hat and read the case. Anyone got a case # to go along with this story?

Trial just occurred, so will not be up on lawcrawler.com yet, but go to jfpo.org, they have a link to info, and copies of some of the documents on line. Cannot believe that a decent attorney could not get a case like this tossed- there are two elements to a crime- mens re (aka scienter) meaning you INTENDED to do the thing, and actus re- you did the thing. Somebody would have to prove intent. Feel like this one ain't over yet.

This story was supposedly from a reputable news source but the author has made a glaring error in grammar using "loaned" instead of the correct verb "lent." Makes me wonder if the story isn't a hoax written by someone other than a professional journalist who should know better than to use the noun "loan" as a verb.

If it is true story then I cannot imagine how a conviction could be achieved without some evidence that the defendant KNOWINGLY built or owned an illegal full-auto rifle.

Speaking of which, why does the story not mention the type of gun? What semi-auto rifle is well-known for firing unintended bursts?

actually it was this statement among others that jumped out to me

quote:"If your semiautomatic rifle breaks or malfunctions you are now subject to prosecution

they sound like ignorant miss-informed liberals that exaggerate things they do not know much about

No, but there is some truth to the story, which was being discounted as a hoax for bad grammar.....

Read the affidavits, it was probably hard to find a legit writer to take up the cause......

I have repaired three double barrel shotguns, that fired both shots with one pull of one of the two triggers...

So they would have been machineguns. ?!?

    Now... THAT makes sence...

If this were the case then a lot of shot gunners will be prosecuted after their gun malfunctions and "doubles". The feds will have about 2 million shot gunners in their prisons.

I used to have a ruger mk1 rr pistol that would fire 3 round burst due to a worn part scard the poop out of me the 1st time it done it.

A number of years ago the ATF declared some M16 parts would make an AR15 illegal if used to build it. Even if the rufle was still semi-auto the presence of some M16 parts made it a machine gun to the ATF. Could this guy have built a rifle using these parts?

Well the gun passed the first testing. When sent back for a second testing they specifically asked for ammo with "soft" primers. So apparently what the rifle was doing was striking the next round softly, and a hard primer prevented the "doubling" effect.

Just checked some other sources and they said the rifle did have M16 parts. That may have been the basis of the conviction but they also did say that it was because the gun would fire on full-auto when dirty and when using a particular type of ammo.

This shouldn't really surprise anyone. The Gun Nazis have been coming for us for a long time, piece by piece.

It's this sort of crap that drive someone over the edge.

If even 10% of the gun owners in this country stood up and said "screw you" to the ATF that would be enough. We need a couple of "million gun owner" marches.

I wonder if the 3 position selector had anything to do with it?.......

The National Guard has drill instructors? Do they have their own boot camps too?

At least the BATF has made the ruling that a SHOE STRING
is no longer considered to be a machine gun, as per their previous ruling.

    from Merriam-Webster's Online dictionary, www.m-w.com:
    loaned
    loan[2,transitive verb]

    Main Entry: 2 loan
    Function: transitive verb
    Date: 13th century
    : lend
    - loan?able \#712;l?-n#601;-b#601;l\ adjective
usage The verb loan is one of the words English settlers brought to America and continued to use after it had died out in Britain. Its use was soon noticed by British visitors and somewhat later by the New England literati, who considered it a bit provincial. It was flatly declared wrong in 1870 by a popular commentator, who based his objection on etymology. A later scholar showed that the commentator was ignorant of Old English and thus unsound in his objection, but by then it was too late, as the condemnation had been picked up by many other commentators. Although a surprising number of critics still voice objections, loan is entirely standard as a verb. You should note that it is used only literally; lend is the verb used for figurative expressions, such as "lending a hand" or "lending enchantment."

SP: Your Porcinity, perhaps you should contact Merriam-Webster and inform them of their "glaring error," as well.

one would hope it is a hoax...or that it isnt true...there must be millions of double trigger shotguns out there in the world, and they will all fire both barrels if you pull both triggers at the same time...hopefully someone will get to the truth of this story and post it, and if it is true surely an appeal would get the charges dropped.
