TRANSFER ???
bob comes to jack who is a ffl dealer and askes him to send a copy of his ffl to xyz gun co.for a rem 870. jack sends the form with all the necessary information on it :auction #, type gun, bob's address & phone #, also jack's phone #. time goes by, jack recieves no gun. jack calls bob and asks if he has heard from xyz guns. bob says i forgot to tell you i recieved the gun last week. jack asks are you going to bring me the gun so i can do a background check.(bob is a previous customer) bob replies i all ready have the gun this way it will be unregistered.

In this case the dealer was WRONG to send the gun to any address but the business address on the license. If the buyer changed the address and re-copied it, then he is in deep doo-doo.
If this happened to me, I would give the buyer about 60 seconds to have his butt and MY gun in MY shop for the proper entries. If he did not comply, I would be on the phone with the BATF in 61 seconds.
Bob, and maybe the other dealer, did something that would cause me MAJOR problems if the BATF shows up for an audit before the paper trail is straightened out. Cause me a problem and I will cause you a bigger one.
I would also be in contact with XYZ Guns to find out how it was he shipped the gun to the wrong address.0 -
well in the first place how did the gun end up at Bob's place , if as you say Jack the FFL sent out a copy of his FFL

seems to me there is a big problem some where and Bob had better be getting the gun to Jack to have the paper work done , then Jack should be on the phone to the other dealer or person to find out how the gun was sent to Bob in the first place0 -

I think I would make the call even after it (this transaction) is straightned out.....0 -
The bad thing here is that the gun was shipped to a non licensed person. That is already a bad thing for the Selling FFL. They should be notified and given a chance to issue a call tag, have the gun picked up and reship it to the correct address so that all of the correct shipping information is listed. Of course, he is still going to have some odd A&D entries to explain when he is audited.
Now if Bob altered the FFL to show his address, then he is the only one in trouble here, and should be. He is putting two others at risk by his illegal actions. If he did not alter the FFL, then it is the shipping dealer that is at fault and should issue the call tag.
Jack is now obliged to contact the ATF and inform them of the situation to keep from being dragged into this any further than he already is. I would make the call to see what they would want me to do.
We all want the gov. to enforce the laws already in place and quit making new ones, but if we start skirting the ones we have, there is no way we will ever get them repealed.

I would make sure this couldn't come back to bite me since I didn't do anything wrong. I would call the sending dealer to determine whether a shipping error occurred and give him a short period of time to sort out any error he may have made. After that, if the situation hasn't been rectified within the law, I would contact BATFE. I would also refuse to do business with this customer anymore. 0
