41 cal. rimfire ammo
After receiving my certified funds, a Gunbroker seller asked for an FFL permit to ship a pre 1898 handgun that fired 41 cal. rimfire ammo because he said that under North Carolina rules the ammo was currently manufactured and readily available. My reading of the NRA summmary of the regulations for North Carolina (where I reside--seller resides in Maryland)says that pre 1898 firearms are exempt from FFL regulation (as far as the buyer and seller are concerned in meeting the requirements for the two states concerned in the sale). Is the seller correct in this matter? Personally I have purchased numerous pre 1898 rimfire cartirdge hand guns through GunBroker and other sites without the mention of FFL ever arising. I want to follow the law. Please offer some feedback. Is this ammo manufactured and readily available today? Thanks for your input!

No the ammo is not readily available but it is still made in small quantities. The point is that the ammo is made to pre-1898 specs which means it really is not modern ammo. Besides all of that, you can mail antique guns person to person through the US Mail without breaking any laws. Some ATF agents like to interpret the laws to the most assinine degree, but when push comes to shove the 41 rimfire cartridge hasn't been modern since the civil war era. 0
