Selling on consignment ?

My dealer told me today that if you put a firearm on consignment and then later take it off the market you have to have a background check done before you can take posession. He is in the middle of a BATF inspection and that is straight from the inspecting agents.

    If ownership does not change I would not see that being fact. In order to believe that I would have to see the law, I just do not believe the agent, simply because he said so. It just sounds hokey to me.

    YES he is correct . Once it goes into our bound book it must be back ground checked once it leaves the store regardless if you are the owner or if someone else is buying it.

    If the gun is left at the dealer he has to enter it into his book. To sell the gun or return it to the owner, a 4473 has to be filled out and NICS check done.

    Dealer has all his paperwork for the last five years spread all over the place for these guys. This is in rural Wisconsin. You'd think they were selling to gangs. I think they know all thier customers by sight. Waste of taxpayer's money....

    What MFI said. I just bought one off consignment through a dealer I talk to a lot. I only bought it because he had had it over 6 months and told me he was going to have to do the paperwork for me, or for the original owner again. I figured he might as well do the paperwork for me.

    What about a dealer who is a gunsmith? If you leave a gun to be worked on does it have to go into his books?

    Your dealer is right. Once we put it in our books a 4473 has to be filled out no matter who owned the gun. The only time this does not have to happen is when you take your gun in for repair. If you take your gun in for repair then you and only you can come pick it up. If you send your wife or anyone else, there has to be a 4473 filled out. Got to love that paper work.

    It has to be logged into his books, but he does not have to do a 4473 on you to give it back to you.

    I don't do a lot of consignment sales, but here is how I have done some of them:

    The owner retains possession of the gun. I go to the owner's home or office and shoot the pictures. I write down the particulars on a legal pad. Then, I go home and put the gun on Gunbroker. If it doesn't sell, no problem. The owner still has it. If it sells, I call the owner and pick it up from him, then enter it in the bound book and transfer it.

    If it is a "repair" it can be logged into a repair log book and if the same person picks up the firearm you do not have to do a 4473...if it is a different person that picks it up you have to do a background check.

    To get a consignment back you will have to do a 4473....unless it was a "repair" which I think of them as repairs since I clean them up so much.
