    Technically any citizen can effect an arrest but the cops discourage it and for good reason.

    You think you saw a crime committed. Maybe you did. But if you are wrong, you are looking at civil action and maybe criminal charges if you falsely detain someone or pull out a weapon on him.

    The only time I might even be tempted to make a "citizen's arrest" is if I myself were the crime victim.

    saxon I know I seen a drug deal, gal came into c store got money out of atm got into vehicle drove up to another in parking lot a grease ball punk banger gets out of his vehicle walks to hers she puts money in hisa hand and he put something small into her hand....she drives off... he them drives off.

    Different states have different laws about such. Last time I checked in SC it had to be a felony or, get this, shoplifting. Either way, you have to witness the crime. For liability reasons it's best to just watch, document and report. Unless, of course, it becomes a hazard to you or another member of society. If they are shooting at each other, let them kill each other. If it endangers normal people, act.

    Could have been an undercover cop doing the buy or the sell. Never know these days. Our Sheriff dept has some real scumbag looking undercover cops. They pulled a good one just the other day at the little shopping center in our home town. Mailed flyers giving away TV's and vacations to criminals. Hooked a bunch of them on a scam when they showed up to get their free merchandise.[:D][:D]

    FWIW, you THINK (OK- you are pretty darned SURE) you saw a crime being committed. What was the "small" something he put in her hand? Yeah, it was likely a rock of crack. But unless you have "probable cause" that the item was an illicit drug, you don't have grounds for an arrest. Neither does a LEO- requires further investigation. You are dealing with two separate legal worlds- criminal law, and civil law. Tread carefully. And yes, understand the frustration.

    There are very few times I'd ever be tempted to effect a Citizen's Arrest. And a drug deal ain't even on the list. There are just too many things that could go wrong.
    You'd be facing more than one opponent, because neither party would be "the aggrieved" so to speak.
    Chances are good that one of 'em would be armed.
    Chances are good that at least one of 'em is under the influence of drugs, or seriously needing drugs, which would make them even more unpredictable.

    Man, I'd just keep moving on. But I'd try to get some kind of description for future reference.

    The laws are different in each state.
    In some states, yes it is legal.
    In other states,no it is not legal.

    I actually saw something similar happen out side a pharmacy here. Guy comes out of store with pharm bag, goes to a guy, money exchanged, guy opens bottle gives a few pills, and they both leave.

    I would have atleast pulled out your 30/30 and tried to arrest them... But i probaly wouldn't have gone so far as to shoot them unless they produced a weapon.

    but heres another issue entirely. fair enough, you witnessed an unlicensed pharmaceutical transaction. but what if the pills were viagra and the buyer was just to embarrased to buy them himself? now granted they were probably oxycontin but thats not the point. technically illegal, yes. going to be arrested for, nope.

    Unless someone was being seriously injured--call the cops-that is what they are being paid for. I agree with select-fire that it could always be undercover cops-and boy wouldn't you love to get chewed out for screwing up their bust.

    I effected an armed Citizen's arrest in May of 1999. Two guys shoplifting expensive stuff from chain stores. Called the policemen on my cell, followed the bad guys through two towns, til they went into another store to jack, blocked their van with my car. When they came out, I put my 629 on them and had them kneel until the policemen showed up - 3 cars from one town, two from another, and a State Trooper.

    Both had warrants out for armed robbery. The policemen told me "good job - don't do it again"

    I was on the phone with the dispatcher the entire time. She asked me what kind of firearm I had, and when I I told her it was a .44 Magnum, she said: " For God's sake, try not to shoot anyone with that !!".

    The adrenaline rush was almost enough to give me a heart attack.

    It had been many years since the last time I had thrown down on anyone.

    Question to myself: would I have actually killed these guys?? If I did, would I be able to live with that fact ??

    I'm glad I didn't have to find out.

    stay out of it. getting involved will cause you more grief than you will want. lets the cops handle it.

    wow. You describe a drug deal with a gang banger and you want to "citizen arrest" them. Wow you have got some balls. I have had some friends that fell into the gang scene and contrary to popular belief a true killer gang banger knows how to use his weapon. Most likely that gang banger has used his weapon and he used his weapon against individuals that also had weapons they knew how to use.

    Something you might want to know; in the gang world dealers are like sergeants, they paid there dues before they got the privilege to deal. More likely than not, that dealer was a foot solider (killer) for some time before he is allowed to play with gang money/drugs.

    ballsy? maybe. people in this country need to get ballsy....kids dealing drugs in plain view of anybody looking in broad daylight.

    I know my abilities with the shooting irons.[;)] also fear is what you know about yourself.

    I was just asking if it is legal is all .....if I could have gotten plate numbers I damn sure would have called them in

    My advice, NO. If you don't know the legality of a citizens arrest in your state, and it not a matter of saving someone's life, then stay away from it.

    What you can do is covertly tape or take pictures, record license plate numbers and descriptions, and call police. Even if it looks like a simple drug bust, there may be more players that are easily visible.

    The Colonel hit it right. Vice crimes shouldn't even be crimes. Mugging, rape, murder, robbery, poofing, arson, stuff like that, in addition to personal defense, are about the only things a passerby should concern himself with.
    Card playing, prostitution, and private pharmaceutical aquisitions are the business of the parties involved. [;)]
