A True Christmas Story
It was a child custody issue over where the children would be on Christmas. No-good sorry deadbeat Dad said he was coming to get his kids from the custodial grandparents. Grandpa told Dad it isn't his year, and to contact the kids after Christmas. Dad said he is coming anyway.
Well, he did come, but things did not go well for him. Grandpa had sent Grandma and the kids away, and sat home waiting for Dad. Dad showed up and knocked at the door. Grandpa opened the door and told him to go away. Dad then made a bad mistake. He tried to force his way in.
I took the call to see Dad at the ER. He had taken a pretty good beating. Eyes were swelling shut. Nose was broken. Multiple lacerations and contusions. Loose teeth. He wants Grandpa arrested.
Grandpa also called to report the incident. I went to see him. On the front walk was a very easy to follow blood trail, still fresh, since it was a cool day.
I've known Grandpa for many years, and know him to be a stand-up man of good moral character. I've never even heard him utter a curse word or raise his voice. Even so, I tried to approach the investigation dispassionately.
Grandpa said he did send Grandma and the kids away, and did lie in wait for Dad to get there. To my way of thinking, that was Grandpa's only fault in this incident. He could have left with Grandma and the kids and left Dad to knock with no answer, but he didn't.
Grandpa told me he answered the door when Dad knocked, and Dad tried to force his way in. Grandpa said he only did what he had to do to get Dad out of the doorway and off the porch.
"What did you hit him with?" I asked.
"Just my fist," Grandpa replied.
So, I asked, "How many times did you hit him?"
"Two, maybe three times."
Well, thought I, those "two or three" punches must have been lulus.
Family Violence law applied, but as I understand the spirit of the law, an arrest is made to prevent further violence. Well, I didn't believe there would be further violence, since it was unlikely that Dad would seek a return engagement. I also took into account that Dad had been told not to come, but he came anyway. It bothered me that Grandpa lay in wait for Dad, and then beat the tar out of him. On the other hand, it was Grandpa's home, and he did tell Dad not to come, and he claimed to use only the force required to repel a trespasser.
I filed the reports as required, listing Dad as victim and Grandpa as suspect, including statements from both parties, and pictures of Dad, and Grandpa, and the scene of the incident.
A few weeks later, I received a Disposition Report from the prosecutor's office. The prosecutor had declined to file an Assault charge against Grandpa, citing a lack of incriminating evidence. That was the ending I had hoped for.

Using that line has saved me from several fights and have got me several free beers too... I always tell someone that wants to fight they better be careful cuz I'm going to beat their hands so bad with my face that they won't be able to pick up a beer for a week... every one of them have laughed their asses off and bought me a beer instead of wanting to fight0 -
