I fail to see how a theft is not for financial gain.
You steal your food, clothes and other necessities and use the money saved for something else.

That's how it will wind up. IF the police are called, and IF the police even respond, the responding officers will look at the circumstances of the case, and if it is non-prosecutable, they will not make an arrest. Why bother?
I ran into a similar situation at Walmart. An elderly handicapped man stole some grocery items. Walmart called. I responded. Manager says he wants to report a theft, but he can't prosecute. He said Walmart policy is to not prosecute small thefts if the suspect is over 65 years of age. Since Walmart would not prosecute, I refused to make paper on it. I told the manager that I may have to start a new hobby in a few years. I haven't done it yet though.

I'm not familiar with Texas laws, but I hope that they have the castle doctrine law. If the law won't prosecute... that might deter criminals, otherwise nobody will be safe.. Just saying 0 -
