Just another matter of trying to bankrupt a legitimate company out of existence. Whether or not the libs win the lawsuit, they still win their ultimate goal.

I don't see how this doesn't just open the can of worms that would let anyone hit by a drunk driver sue an auto manufacturer.

"Gottlieb went further, arguing there is no evidence connecting Lanza with Bushmaster?s practices. ?There is no evidence the killer was driven by any advertising whatsoever,? he said."

This is an interesting remark. Let's suppose Bushmaster did market the firearm as plaintiffs allege. Are they required to show it was the proximate cause of Lanza committing the crime? And if so, how is that proved? Further, young Lanza was neither the purchaser nor owner of the firearm, nor was it purchased by his mother for him. For the marketing offense to be valid wouldn't it be necessary for the mother to be the one to have committed the crime?

If I buy a Porsche because it's a fast car and kill someone while speeding it could be suggested the advertising is responsible for me purchasing and then using that particular vehicle in a negligent manner. Quite a stretch. But if that same vehicle is stolen from my garage and misused how can it be said the advertising is at all relevant?

Or is it sufficient under law for the plaintiffs to merely demonstrate the advertising was flawed?
