Alabama Woman Who Joined ISIS

(WASHINGTON) ? An Alabama woman who joined the Islamic State group in Syria won?t be allowed to return to the United States with her toddler son because she is not an American citizen, the U.S. said on Wednesday. Her lawyer is challenging that claim.
Secretary of State Mike Pompeo said Hoda Muthana, who is now in a refugee camp in Syria along with others who fled the remnants of the Islamic State, has no legal claim to citizenship and will not be permitted to enter the country.

If she was born here, then she's a citizen. She should be allowed to come back, and when she crosses the border she should immediately be arrested, charged, tried and if convicted spend the rest of her days in prison. There are alot of questions surrounding this situation. I am curious if she doesn't have a pass port how did she leave the US and enter all these other countries? 0 -
i agree she is a citizen , unless she renounced it when she left. that is not known to my knowledge...therefore since we are a nation of laws, we cannot prevent her from re-entry. we can prosecute her when she does return for all sorts of crimes. 0 -

Actually that would be known by the Gov. There is a specific process required to renounce your citizenship, just saying it is not enough.
Renunciation of U.S. Nationality Abroad
A. THE IMMIGRATION & NATIONALITY ACT
Section 349(a)(5) of the Immigration and Nationality Act (INA) (8 U.S.C. 1481(a)(5)) is the section of law governing the right of a United States citizen to renounce abroad his or her U.S. citizenship. That section of law provides for the loss of nationality by voluntarily and with the intention of relinquishing nationality:
"(5) making a formal renunciation of nationality before a diplomatic or consular officer of the United States in a foreign state, in such form as may be prescribed by the Secretary of State" (emphasis added).
B. ELEMENTS OF RENUNCIATION
A person wishing to renounce his or her U.S. citizenship must voluntarily and with intent to relinquish U.S. citizenship:
appear in person before a U.S. consular or diplomatic officer,
in a foreign country at a U.S. Embassy or Consulate; and
sign an oath of renunciation0 -
She burned her Passport and renounced her citizenship numerous times on social media. She also used social media to propagandize ISIL.
Whatever happens to her I hope its bad. She is a terrorist and a traitor.0 -

That's not enough....by law she has to appear at a US consulate and declare her desire and swear to it on a document in front of the Consular officer.0 -

Roger. Some folks want to make an emotional argument, and this is about a legal argument. SCOTUS ruled in 1967 that birth right citizenship can not be revoked by the government, it is a natural right, not given by government. So if you are born in the US you will forever be a US citizen, unless YOU choose to renounce it.Sam06 wrote:I know its not enough to be legal.

There is a legitimate question as to whether her father was here under a diplomatic visa when she was born. He had the State Department write a letter in 2004 that magically established the end of his diplomatic status 1 month before here birth in 1994, but I have not seen where his status regarding the visa had changed. Were he and his wife still in country under a diplomatic visa, she would not be a birthright citizen regardless of whether he was acting in a diplomatic capacity or not.
The 2004 letter was used to gain her a US Passport (with the presumption of citizenship); a passport that was renewed in 2014 prior to her leaving to be an iswas concubine.
If there is a legal mandate to allow her back into the country, she should be allowed back and tried for treason whatever can be pinned on her for giving aids and support to the enemy.
If there is not, my thought would be to allow her to lie in the bed she made.0 -

I would say there is a lot of doubt on whether she is a legal US citizen.0 -
BUT...BUT. She wants to come "home" and thinks she should receive punishment of getting some therapy, that should make everything good.
Just let her stay where she chose to go and rot.0 -
