This happened in my town. The husband had a felony, but the wife had a gun collection. The resolution required that the husband NOT have ready access to the guns. A locking gun case with the wife ONLY having the combination or key was the accepted solution.

    G. Gordon Liddy often talked about this on his radio talk show, and that was a great talk show, now, extinct.

He was, of course, a convicted felon. Often talked about how much he loved the .357, which he carried when he was an FBI agent.

And he often said, "I have no guns but Mrs. Liddy has a great collection."

She had a gun safe, and Gordon "Did not have the combination."

This is generally what happens. Suspecting and proving are two different things!

I have a elderly friend in Indiana that has a son with a clean background but the son's wife has multiple DUI offences and is now a convicted felon. Can the son legally have a firearm in his home? My elderly friend wants to will them to his son.

    Thanks guys,

    Short answer is yes.

    Long answer is yes.

Do not conflate the word "felony" with "prohibited from possessing firearms".

If you read the law (GCA68), you are prohibited from possessing a firearm upon conviction of a crime for which the punishment could be imprisonment for > 1 year. Some states have misdemeanors that carry a possible penalty of up to 6 years in prison.

A "prohibited person" may not possess a firearm. That means they cannot hold it, nor can they constructively possess it (have the keys / combo to the safe). Can the non-prohibited spouse possess? Under Federal law, yes.

Depends on the state, I learned that Montana will restore gun rights to certain felons. I knew of a person convicted of a sex crime, felony and was allowed to carry a firearm under state law, he just cannot buy one on a 4473.

In some states, a felony can be expunged. Then the person doesn't have to mention or note it unless specifically asked.
