    The way I see it, you've been more than fair. He got himself into this fix, I'd say he needs to man up and get hisself out of it now.. You didn't take him to raise..

    If you pay him you are enabling the behavior to continue and it will for sure continue. So, pay him any EARNED vacation and sick time and let him stew on his chosen path. Trying to help the addicted begins with not being a piggy bank for the addicts misfortunes.

    I'd can his butt. But that all depends on the HR refs. I'd think that missing that much work would be grounds for canning.

    You've given him enough money during his last absences. Too bad he got caught while doing a favor. But he could have gotten caught for speeding so tough for him...

    I would consider doing something to ensure the 5 year old is being well cared for, but so far as the father, I don't see where you owe him anything other than whatever vacation pay he has accumulated.

    Smoking and drinking causes serious health problem and IMHO you are subsidizing and financing such behavior.

    The only good thing is he is close to the shop.

    I would give him 2 weeks pay and say adios amegio.....

    Another way to look at it is this. You took money from your pocket and GAVE it to him. You are a good man! Now with this criminal issue you can no longer justify the charity you extended to him in the past. Why? Because your charity gave him a unearned handout, a handout he has repaid you with a kick in the crotch with.

    Your other GOOD employees see this and I assure you there is a simmering resentment. They work and get paid, he does his thing and gets paid for doing nothing. Kind of sounds like Congress to me.

    You didn't create the warrant, he did. Why should you have to pay him the time spent in jail for his mistakes?. The the government won't even pay somebody while in the jail, they figured he made his bed, now let him sleep in it. why should you have to pay for his mistakes...

    I think it's time he learns a valuable lesson, and he won't learn that while drawing a paycheck well living a life of leisure in jail.. I think if you do getting my paycheck, I think he'd go on a crime rampage just to get thrown the back in so he can live that life at leisure while you pay him to do it.

    On the other hand, when it goes to the judge he probably won't have to spend that 59 days. But in the meantime I would be looking for an A+ worker...

    Also, if he has any vacation or sick time coming, that would be considered forfeitted because he quit...

    You certainly seem to be a great boss, likewise, you seem to value the guy's work as well or you would have cut him loose by now. I also don't think you owe him anything and, in fact, you probably did him and his family a huge favor, perhaps, your asking him to go to the shop was a blessing in disguise for all parties, regardless of where he ends up in the future. That said, I like the compassion that you have shown to him in the past, because not many folks have that big of a heart. I also like what Don said regarding his daughter.

    The dude needs consequences. Let him have some. Don't subsidize poor behavior. If you're going to take him back, do so only conditionally. The drinking has to stop. Then be ready and willing to fire him at any moment and tell him so.

    The child has a mother, you are not responsible for the child even while he's in jail, she is. He knew he had a warrant, that is not your problem, it's his. You didn't ask him to go to the shop knowing he had a warrant out for him. You did not intentionally harm him.

    If you want to hold his job, that's up to you. I can't see where you owe him anything. On a personal level you may want to help him, up to you. On a business level you owe him nothing.

    Running a small business at one time in my life, this guy although with child has not EARNED anything other than termination. C- grade doesn't help either/ Separate the child from your decision and you know what to do. To many negatives here. imo

    Personally I thought the story was gonna lead to him robbing the shop. Maybe when he gets out?

    Seriously...talk about getting taken advantage of...dude has a warrant for a probation violation and his employer feels bad???

    If you like the guy and his work is at least acceptable to you then keeping him would be your personal decision but you sure as hell shouldn't pay him 59 days wages because HE screwed up and then didn't complete his obligation to the law.

    Even though I never pulled the same stunts that he did, I would have loved to have just ONE boss in my working career like you.

    And I agree that rewarding him would be enabling his behavior and counterproductive to his rehab. People need to stand up and accept responsibility for their deeds.

    I agree. You have been more than kind to him and did a great service by helping him when he was sick. This is a different matter and at some point, he needs some tough love.

    I'm not saying this will get the job done, but maybe, just maybe, the light bulb will flicker for him.

    I think I would look at his job application to see if he didn?t fill it out legitimately.
    Then contact the state labor board about it, asses if he is a threat to the business living so close and the let him go with 2 weeks pay for the arrest and not showing up for work. Don?t mention the sick time.

    While you didn?t create the problem. You want to make sure you don?t get jammed up for it either. The world seems to have gotten all upside down lately and it?s only the folks that work hard and take appropriate risks and get ahead that seem lately to carry the brunt.

    Dude, don't pay him for his jail stint! He KNEW he had that warrant and did nothing about it. So now you think you need to pay for his issue? Would you give him two months pay if he got picked up on a traffic stop?

    Keep him as an employee when he gets out if you want, but you don't owe him anything.

    Cut the losses and move on. Put out a hiring sign. Don't let his example cause a cancer to the other employees. They most likely know what went on.

    Geno, you are required to give pay for pay earned, that's all. You are not a registered charity.

    He's now an ex-employee.
