Kagan is stating that a Supreme Court made up of nine people just like her would be illegitimate. She is in effect stating that her decisions are illegitimate.
If any justice on the Supreme Court does not believe that a court made up of 9 justices who would decide the way they decide would render correct decisions; that justice should be removed.0 -
I doubt Kagan has ever been a "swing" vote. She has no business in the SCOTUS. 0 -
If SCOTUS Justices based their decisions solely on the Constitution instead of agenda driven partisan politics, NONE of them need worry about their 'legitimacy.' 0 -

What is the background of Justice Elena Kagan:
Being able to stay out of politics: Kagan is No. 2, right next to Justice Ginsburg who for sure has the No 1 place.
Out of the country and didn't watch. Were there riots in the streets, protests, false witnesses? was she borked? I'd bet not.

Why does there have to be winners and losers?
If 9 justices who presumably are the brightest and best when it comes to the constitution can't all agree, they all need to be fired, and put in jail for at least a year.
The the constitution was drafted, was there any dissent on any of the issues or did they ALL decide on it and sign it?0
