    A sideways step, perhaps.

    Kennedy was an interesting justice, and was less of a swamp dweller than is Kavanaugh. Some will disagree with a number of Kennedy's other positions, but it is unlikely that Kavanaugh will be a better advocate for individual liberties than was Kennedy.

    The commentator, who is obviously an ACLU attorney or staffer, is building his case on the prevailing thinking at the time of the 9/11 attack...we had no warning and got blind sided on 9/11 ?that had to be fixed.

    Kavanaugh was the Bush attorney and was helping formulate legislation to be put before the Congress which would somehow provide a means of staying ahead of any future terrorist attacks...

    The Patriot Act, according to the ACLU, is said to violate the 4th Amendment in four areas:

    1.Records searches. It expands the government's ability to look at records on an individual's activity being held by a third parties. (Section 215)

    2.Secret searches. It expands the government's ability to search private property without notice to the owner. (Section 213)

    3.Intelligence searches. It expands a narrow exception to the Fourth Amendment that had been created for the collection of foreign intelligence information (Section 218).

    4."Trap and trace" searches. It expands another Fourth Amendment exception for spying that collects "addressing" information about the origin and destination of communications, as opposed to the content (Section 214).

    Personally I have no problem with #3 and #4 above ...simply because I am a God fearing , law abiding citizen that does not/would not engage in criminal activity and certainly no terrorist activities...so I will give a thumbs up on #3 and #4 above which have been useful/effective in thwarting several acts of domestic terror.

    Crooks and Terrorists will definitely have a problem with #3 and #4.

    With regard to #1 and #2 above I do have a problem because
    I am a God fearing , law abiding citizen that does not/would not engage in criminal activity and certainly no terrorist activities.

    However the Democrats and Special Council Mueller do not seem to have any problems with #1 and #2 above in their pursuit of Manafort and Cohn in trying to take down Trump.

    So, depending on what side of the fence you are on, the end justifies the means.

    With regard to Justice Kavanaugh and any future issues regarding the 4th Amendments and the Patriot Act... He will view the issues as a Supreme Court Justice not as an Attorney based on his track record.

    The end never justifies the means, and the commentator is not a an ACLU attorney. And while he has delved into bizarre territory such as pizzagate, he is entirely on point here.

    I should also add, if you like getting groped by the security theater TSA, then you probably do also like Kavanaugh.

    Opinions are like belly buttons...everybody has one. I am stuck with mine and you are stuck with yours...but nobody else is.[:D]

    You are right the end never justifies the means, but you will never sell that to the Liberals noted below....

    I should have said, It depends on whose ox gets gored.

    Standing Ovation for Kavanaugh... and the Bronx Salute to Chuck Schumer, Nancy Pelosi, Cory Booker, Diane Feinstein, Ms Hirono, Kamala Harris and anyone else that thinks these bottom feeders are honorable people...
