She had every right to be there. The rght to peaceable assembly is guaranteed in the Constitution.

She didn't deserve to be shot. But she was trespassing in the Capitol building. That's illegal.

Trespassing in the Capitol is "illegal" AND a capital offense?

(Yes, I did check the spelling.)

Do they have "Use of deadly force authorized" signs posted?

Do I need to post these signs in my backyard, if someone is trespassing there and I just decided to kill them?

I know this is a politically and emotionally charged subject and everyone, including me, has an opinion about the events of that day. To put it in perspective concerning your backyard trespassers, she was shot climbing through a window that her group broke in a locked and barricaded door. If you were home with your family and someone smashed one of your windows and was climbing in - what would you do?

While I sympathize with her family, I think of this as a "play stupid games, win stupid prizes" scenario. What did she think would happen breaking into a locked room harboring members of congress and armed police charged with protecting them? I respect everyone's right to protest, but she crossed the line and I think the shooting was justified.

I agree Bob. Members of Congress were in that hallway and they were very scared and were escaping. There was a big door 6 feet wide and on either side of it big windows. Armed guards were standing in the hallway ordering the protesters to stay put and not come through the door. Some idiot protestor broke out the window. With a guy aiming a Glock at the window, and yelling not to come through, Ashli decided to climb through the window.

Whatever I would decide to do, if someone ended up dead, would there be a trial . . . or an investigation?

If I decided to investigate myself, would it be acceptable for me to find myself justified?

The U.S. Attorneys office, the DOJ and the Metropolitan Police all investigated the shooting along with the Capitol Police internal investigation. I doubt if you or I would warrant 4 agencies investigating either one of us shooting an intruder violently breaking through a door into our homes. Who else should have investigated? Bob

While it was tragic that she lost her life, there are some people that don’t listen or feel that warnings don’t apply to them. There are also some people that are directed through special orders assigned to their post to use deadly force as directed in their special orders. I would be interested in reading what the officers special orders entailed.
Most generally in the military, when a building, bunker or other named area is separated by two fences, and deadly force is authorized to protect that area, your special instruction will lay out the procedure to follow. Example, if someone is approaching the first fence they are told to halt, if they cross the first fence a warning shot is authorized, if they attempt to cross the second fence, deadly force is authorized. I would imagine there are special orders in the same way if you were assigned to protect a section of fence say at a prison.
The reality is, if there are special orders in play, and you don’t follow those orders, you could find your self facing charges.

The same type thing happened last century with our WW-1 veterans/soldiers peacefully protesting the Government lack of fulfilling their promises to the soldiers. Our founding fathers gave us the privilege and right to protest the wrongs our politicians do as long as it was peaceful, the government will always make sure it's not a peaceful protest……… and that you can take to the bank.

To be fair, The Bonus Marchers were requesting early payment of WW1 bonuses during the depression and no legal justification for the request, just as there was no legal justification for the entering of the Capitol building.
That said, I have more sympathy for Ms. Babbitt than the frightened Mall Cop that shot her.

I too probably have more sympathy for Ms. Babbitt. Unfortunately, in the heat of the moment,Rules of Engagement can be changed or ignored completely. IE: Ruby Ridge, On the stand, proven Rules of Engagement be damn. The sniper, a West Pointer, wanted them dead.Where was Duty,Honor,Country that fateful day? Friends, classmates,FBI,US Govt. have his back to this day. I believe we all have a conscience, even those on the gallows who are guilty but profess their innocence, unless mentally ill.

Who amongst us can look into another man's soul and say what was his conscience telling him that fateful moment. Thank God, I did not have to make the decision that took Ms.Babbitt's life.————Ray
