NIGHTMARE! Return Gun proceess -- Please Read
Have anyone had to go through the process of requesting police to return gun???
I experienced a living nightmare that changed my perception of most police, I now have a deep dislike of MOST not all police!!
Early a.m. a few months back, my dog started going crazy then I looked out the window to see a big fat person creeping up to my patio window wearing tennis shoes holding a 9 mm pistol. I immediately grabbed my ak-47 then told my wife and daughter to go in the bedroom and lock the door.
Then I heard a knock at the front door and the person started yelling that they were the police "open the bleening door". Since I have never heard or seen police act or look like these, I called 911. The 911 operator told me they were the sheriffs department. I was a little relived but still cautious. I then placed my gun well out of view behind my couch. When I opened the door they burst in with guns and a bunch of nasty oatmeal.
They told me that there was a warrant for my arrest for child support in another state and I was a fugitive.
THIS WAS SOME oatmeal BECAUSE MY DAUGHTER HAD COME TO LIVE WITH ME 4 YEARS EARLIER!!! HER MOTHER NEVER GAVE ME A DIME!
ok.... I am going to make this a shorter story than planned, I am running out of time.
They went through my house, said my gun was illegal and I would be charged with a felony (A LIE SEMI-AUTOMATIC NOT ILLEGAL IN MARYLAND).
After getting to the jail, they said my gun was stolen (A LIE IT WAS REGISTERED HAD DOCUMENTATION FAXED)
The next day after all other lies failed they charged me with child endangerment (A LIE, MY DAUGHTER WAS 19)
After spending a week in jail until the other state tried everything to justify their mistake, they dropped the charges. I posted bail then hired attorney.
Went to court, case dropped.
My question to members any advice of potential pitfalls to avoid while requesting a gun to be returned? I do not trust police.

Stay calm, take all documentation with you and nicely ask them to return your property. If you've not committed any crimes, no doubt they'll return it with no problems. 0 -
Be prepared for this to take a while. I would talk to my attorney before starting the process but would try to get it back without the attorneys intervention first. They give you a problem, call in the attorney. 0 -
Once upon a time I had two guns taken by the Orange PD. I went to the station two days latter and asked for my guns back. I was told come back with a sales receipt and I could have my guns back. I was only able to come up with one receipt. I guess the OPD got to keep a NIB HK Super 90 12 gauge.

Pay your child support. Doesn't matter if your daughter lives with U , U have to have a COurt Order stating your child support has ceased then go down to the clerks office and make sure they know it for sure. Or U get what happened to U ! 0 -
Melkor, You are correct as far as you go. I had a similar situation in that my 16 year old daughter wanted to live with me and her step-mother. I was under a child support order. I was told it could take a year to get out from under that order. In the mean time I was supposed to pay my ex child support for a child that was living with me! I went to the local Child Support Enforcement office here in N.C. and explained the situation. They said the solution to my problem was to pay to the state office the monthly amount. The state would hold this money until a court could decide the rightful owner. 7 months later I had a court date. (Ex had already tried to file for non-payment but State would not allow as I had been making payments.) I was the only Father that day that walked out of the Domestic Court with more money than what I entered with. Judge even acted a little surprised when he realized what was going on. Sometimes there is justice. 0 -
