Interstate transfers- relatives

    Go to the NRA's site and rummage around. I'd guess that it's got to do with State laws, more than anything else.

    I checked my copy of Federal Firearms Regulations Reference Guide (ATF P5300.4), and found on page 50:

    "(a) Shall not preclude any person who lawfully acquires a firearm by bequest or intestate succession in a State other than his State of residence from transporting the firearm into or receiving it in that State, if it is lawful for such person to purchase or possess such firearm in that State."

    So, the degree of relative doesn't matter. The law in the state in which the inheritor resides is all that counts.

    Neal is on the money as usual, the interstate succession clause allows you (or them) to receive the firearms that were left to you (or them), federally. In other words, federal law allows for the firearms to be bequeathed, transported and or received into another state without going through an FFL.

    However, as Neal said you need to know what the laws are in the state that you (or they) reside ... i.e., what is allowed, what is prohibited, as far as ownership is concerned.

    Chances are, if none of the firearms in question are out of the ordinary there shouldn't be any trouble, but Illinois law would clear this up.

    What specifically are the firearms, and where in Illinois ...

    Those answers could shed more light on the issue.

    They don't live in Chicago, I know that it has many exceptions; but in corn country between decatur and springfield. The collection is about 15 custom built black powder guns, A few collectable S+W revolvers, Mausers, falling blocks, and a couple Sxs Shotguns. No NFA weapons. Thanks for the input.

    Why don't the heirs just drive over there, put them in the trunk of their car, and drive home? Or, you could be a nice guy and take the guns to them.
