    I'm selling an old Martini (over 50 years old) with a new .222 Remington barrel. Prospective buyers are telling me it's a C&R. Is it? If you say "yes", please post an ATF reference.

    I'm not sure I follow you here. Are you aquiring a C&R gun and then selling it to a non licensee? If this is the case be VERY careful because this can be considered being a firearms DEALER and not a COLLECTOR. Your license allows you to aquire C&R firearms from any source to enhance your personal collection. You may also freely trade or sell these friearms to other collectors. If you resell a firearm to a non licensee that person must be a resident of your home state. If you are using this C&R license for the purpose of reselling these guns to non licensed individuals with the idea of making a profit off of the sale you are headed for trouble! You need a TYPE I FFL dealers license. A lot of folks get into trouble here and there is no set definition of being a dealer by the BATF; if a compliance inspector "thinks" that you are dealing in firearms that is all that it takes to make you a dealer. Watch your step! If I misunderstood your question I'm sorry.

    The correct answer is NO. The C&R is for your collection only. No selling from you, has to go through a FFL holder.

    If you are buying a C&R eligible rifle from a public citizen and you have a C & R license you must in the State of Kalifornia go to a fully licensed FFL holder and do the transfer there. You WILL be charged for a background check on the rifle regardless if you have a Federal license to purchase eligible firearms.

    I have a C&R and have bought and sold, it is known
    as improving your collection. You can decide to take
    your collection in a different direction and sell
    guns you no longer collect to buy guns you now collect.

    That is only true if the rifle is less than 50 years old. Private party sales of C&R rifles and shotguns that are over 50 years old are legal in California and do not have to be processed through a licensed dealer. Neither party needs to have a C&R license.
