questions about selling firearms?!
Can i sell my rifle to someone that is eligible for it?im not no dealer but have to sell my rifle so will i get in trouble if i sell it?do i have to give the original paperwork or whatever along also?

If you sell the gun to an individual, it must be to a resident of your state. The sale must be in compliance with your state's laws; not knowing where you live, we can't help you with that. At a minimum, you must SEE the buyer's drivers license, and you would be well advised to copy all information on it for your records.You may also sell it to a Federal Firearms Licensee in any state; you must have an ink signed copy of his license if not on his premises.If you ship the gun, you must comply with the shippers regulations, as well as Federal law.Confusing? If you are concerned I would take it to your local dealer and ask him to do a transfer for the gun to your buyer. He will probably charge you $20 to run the guy through your state or BATF check , but atleast its out of your hands and the guy will be properly background checked for ownership. 0 -

Here is what the BATF regulation book says.From page 135.(B1) To whom may an unlicensed person transfer firearms under the GCA?A person may sell a firearm to an unlicensed resident of his or her State, if the buyer is not prohibited by law from receiving or possessing a firearm, or to a licensee in any State. A firearm other than a curio or relic may not be transferred interstate to a licensed collector.(18 U.S.C. 922 (a)(3) and (5), 922(b)(3), 27 CFR 178.29.End of quote.Now we all know that an unlicensed person can sell a long gun to an unlicensed resident of another state. Herschel, you have to read the first part over again. It says Transfer, not sell. You can sell to another in another state, but it must go through a FFL dealer.

aglore, Transfer means sell, donate, give loan, etc. It must go through a dealer if transferor and transferee are not licensed and are residents of different states.It can cross a state between unlicensed persons only by inheritance. Posting misinformation here can cause someone to unwittingly violate the law. Please cite the source of your information. 0 -
