c&r to c&r ??? side note

can a c&r send a handgun (c&r eligible)to another c&r by usps???
Don't remember if I ever seen this question before.

My c&r was turned down at a local sporting goods store yesterday. Doesn't bother me about the few days wait, but the 8$ background fee upsets me.

    Yes... as long as State laws/regulations allow it (Kalifonia doesn't[V][:(!][V], and I'll bet states like NJ, MA, and NY would have problems with it.

    The U.S. Postal Regulations only allow dealer to dealer shipments of handguns (with a few narrow exceptions). By definition Curio and Relic FFL holders are not dealers so they are not allowed to ship handguns through the mail. Use FEDEX or UPS.

    But....you can only ship from a UPS/FEDEX customer counter, not a shipping center.

    And....you must ship Next Day Air.

    And....you should declare it as "Firearm for repair", even if you are selling it. It's a lie, but a necessary lie, & it's legal.

    You've got to address 2 problems:

    1) Federal law requires that a nonlicensee must notify a common carrier if he is shipping a firearm, & the shipper must request an "Adult signature required" label. If you declare your package as "machine parts", & it is lost or damaged, they will not pay to replace; worse, if they inspect the package & determine that it contains a firearm, they will notify BATFE & you will receive a visit from someone with a bulge in his cheap suit.

    2) Many UPS clerks do not understand the UPS Tariff description of Firearms And Ammunition, page 5, item 425. They believe that they can only accept a firearm from a dealer, or a nonlicensee if it is for repair or customizing. Walleyeman only has a C&R; they may not accept it, because they will know that he is not a dealer. (Shipment of a firearm from a nonlicensee to a C&R or dealer FOR SALE may be legal, but it is not permitted under the UPS Tariff.)

    So, declaring the contents as "firearm for repair" will be legal as far as GCA68 goes, & UPS will knowingly accept responsibility for shipment of your firearm.

    Wally there are lots of gun stores which will not honor a walk in sale using a C&R FFL. The reasons for this vary widely but the bottom line is that the purpose of the C&R FFL is to allow the interstate purchase and shippment of firearms to you and not for over the counter sales. I'll accept a C&R without any problem but I know many other dealers who will not.

    I guess it was just the way it was handled. No explanation-- manager said I know nothing about it. And they sell firearms. The law says, I believe, the dealers must pay for a background check and they may pass this on to the buyer. It was the fee that got me mad I guess.
