can he send the gun to my FFL??

I purchased a revolver on Gunbroker.com I went to my local FFL and asked him to send his FFL to the private seller in another state. The seller was then going to send the revolver directly to the FFL here and I would pick it up from him after he did a background check. My local FFL says he cannot send his FFL to a private individual but only to another FFL.
I think he is wrong. Am I wrong? If you have any legal authority (the section of BATF federal law covering this) it would be helpful. I am in the process of looking it up myself today as time permits. Thanks.

    You should pick up his FFL and send it along with the money to the guy. He will in turn send the gun to your FFL.

    If the person you are buying the gun from is relying on your FFL File Copy to ship the gun, your FFL's reluctance to furnish a copy is stopping this from happening. Some Dealers think there could be a problem with sending a Copy of their FFL to a Private Individual. There isn't! If the FFL simply marks "File Copy for (Whats His Name)" the Copy is no good for any other reason and the FFL Dealer's License Number is on the BATF Web site to view.........So?

    If the Seller is a Private Party, your FFL Dealer may not want to receive the gun from him from out of state because he has no way to be sure the person is who he says he is.....may be a stolen gun, for example. A copy of the person's Driver's License would help along with his information, but how to be sure the Driver's License belongs to the person shipping the gun?

    It is much easier to ship from an FFL Dealer to an FFL Dealer, but then there are fees for both ends......but few if any problems. For some of these reasons, FFL Dealers impose their "Own Rules" to make themselves feel "comfortable and compliant." Sometimes there is no reasonable or plausable excuse for their "requirements" other than they can do what they wish within the law because its their business!

    The Fees charged are "found Money" for these dealers, in most cases, but some feel they should have sold the gun from their stock and you end up being penalized for purchasing elsewhere and asking them to do the "transfer" for you.

    Now, simply go find another Dealer that will "help" you get your gun the simplest, and cheapest way! You don't have to jump through their hoops when there isn't a "legal" reason for their requirements! Good Luck!

    I am FFL and I agree with RancheroPaul. And this is how I do transfers for my customes. Some dealers cut there own throats.

    The problem you're having is the reason for the instruction to "have your FFL lined up before you make the purchase"

    Rancherpaul has told you exactally like it is. I moved to NC about 18 months ago and purchase guns on a regular basis. The first two dealers I checked with here wanted to penalize me for doing a transfer. By that I mean one wanted to charge $50.00 & the other $75.00, and would not give me a copy of their license to send to an out of state dealer without a charge. Needless to say I shopped around and found a dealer that is very helpful. Not only does he give me copies of his license to send to other dealers for purchases he only charges $25.00 to do transfers. It is dealers like you mention that are making purchases increasingly difficult for the honest citizen. I promise you though the criminals are still obtaining firearms as quickly as ever.

    Well, you are all right! And RancheroPaul's discussion is excellent.
    I researched the federal law first and no such requirement exists. Then I called the BATF in Kansas City, and they informed me no such requirement exist. The lady supervisor there said to find me a new FFL dealer and I did! Thanks for the input.

    Doesn't a handgun have to be sent FFL to FFL? I didn't think private individuals could ship a handgun to anyone.

    An individual may ship a handgun using a common carrier (UPS, Fedex), but not by USPS (US mail). Both require handguns be shipped Next Day Air, which is expensive.

    USPS may only used for shipping a handgun between dealers/manufacturers.

    There is no such Federal requirement. A handgun is treated the same as any other firearm, except for shipping through the Postal Service.

    Also, there is no requirement for a private individual to have a copy of the receiving dealer's FFL. That is only required in a transfer between licensees. All you need is the first 3 and last 5 digets of the FFL number and you can go to the BATF eZCheck web site to veryify the validity of the FFL and the premesis address.
