stevens 410 pistol

I saw a Stevens single shot, tip up, .410 pistol at a gunshow last weekend. It was not for sale, but was sitting on a stool behind the table. I saw one of these 40 years ago when I was a kid. It is my belief that these are Class 3 firearms and illegal to own without getting the proper permits through BATF. Is this correct? What is the value of these pistols. This one had a rust brown patina, but otherwise excellent mechanically. I told the guy to keep it out of plain sight till he knew what the liabilities were.

    an elderly friend of mine showed me one of his treasures one day, and it was new to me. he asked me what it might be worth. i can't find it in any book. it is a j. stevens breach action pistol in .410 (not a cut down shotgun)with gold bead sight. can't remember model no. and he probably won't show it to me again.
    any ideas?

    According to my references, Stevens made (2) versions of what they called their "New Model Pocket Shotgun" in .410 Gauge. The main difference between the two was the frame material, either brass or iron.
    Unless your friends Pocket Shotgun was papered during the amnesty in Dec.1968, to the best of my knowledge, there's no legal way to transfer ownership or retain possession at this time.
    The above interpretation is quite strange to my way of thinking as Stevens made this Pocket Shotgun for other shotshell chamberings, 38-40 & 44-40shot, 38 & 44 Stevens Everlasting. My reference says these are legal and might even be considered antiques, with no paper required.

    I think if it has a rifled barrel then it is considered legal and not a "pistol shotgun". If not, then I'd sure check into it so he doesn't get in trouble.

    My guess is you saw a model 35 Stevens Off Hand, also known as an Auto-Shot, came in a couple of barrel lengths, 8 or 12 ".

    O.K. Sorry i brought that up. But while we're on the subject, did any of those references say what the value might be?

    I would be pretty sure the pistols would be worth 10 years and a 10k fine or both.
