    IS YOUR GUN LISTED IN THE BATFE C&R BOOK??? IF NOT YOU NEED A FFL

    I WOULD RATHER BE DUCK HUNTING.

    Curio and relic firearms must either be at least 50 years old or on the BATFE list of C&R Firearms which have been determined to be rare, unusual, novel, or bizzare. This could include such items as commemorative firearms which were produced for collectors and not intended to be fired (altough they are fully functional). An antique firearm is pretty much anything produced in or before 1898, although there are a few other narrow classifications for antique firearms as well. A Model 12 Winchester would have to have been produced prior to todays date in 1953 (50 years) to be a C&R firearm. Being a C&R firearm does not exempt a firearm from any laws or regulations, it simply means that holders of a Type 03 C&R license can receive these firearms directly through interstate commerce without the need of a licensed dealer. State laws vary widely on this.

    If you go to the BATF website, and look under C&R license, you can see the whole list of guns that qualify as C&R guns. The Winchester model 12 is included on that list.
