I'm not sure, so take my words as such...
BUT, I think it is the M3 that had the stipulation that you had to reduce the magazine capacity in order to have a pistol grip. Simply put, email Benelli and ask them when it was made to get the date. If it's before '94 then you're in good shape. Of course, now adding certian features to some guns make them an "assault weapon" (whatever the heck that is).
Benelli's are great guns, I doubt you'll be sorry you bought it.

The difference between the M3 and M1 is the M3 can be semi-auto or pump action and the M1 is semi-auto only. The 1994 Crime Bill(assault weapons ban) does say that a semi-auto shotgun may have a pistol grip as long as the mag capacity isn't over 5 rounds. A pump only shotgun and semi-autos with a standard stock may have as many rounds as you wish. So, that person was correct in what they told you.
If you call Benelli USA at (301) 283-6981 they can tell you if your gun is PRE or POST.0 -
If it is pre-ban I am pretty sure it would still be a violation as it was not equipped with a pistol grip prior to the ban. This, however, can be rectified by burning your receipt fot the pistol grip[;)] If it is a post-ban gun you are not allowed to have a autoloading shotgun with a pistol grip and either a fixed mag with a capacity over 5+1 or a detachable mag. The USAS, Streetsweeper, and several other guns then fell under the classification of "Destructive Devices" and required the $200 tax and registration. That is why the Saiga shotguns you see here on GB and at the shops aren't available to you with the regular AK configuration, the pistol grip and the detachable mag would make it a DD. I'd keep the regular stock and the mag extension. Although the pistol grip does make the Benelli look cool the regular-stocked Benellis handle very well too. Good luck[:D]
