Class 3 Transfers
I would like to list a Mossberg AOW for auction. It is currently on a Form 4. Questions: 1. Can I ship to a Class 3 dealer and what forms are required. 2. Can I ship to an individual and what forms are required.

You can ship directly to a dealer who has paid the Class 3 Special Occupational Tax (SOT). If the dealer wants it as a personal firearm then he will be using the standard Form 4. If he wants it for his sales inventory then he will use Form 3 which is used for the tax exempt transfer and registration of NFA firearms to SOT tax payers. When the dealer sends you a copy of the approved Form 3 showing the firearm removed from your name and now registered to him you may ship the firearm. Alawys keep in mind that other than the NFA tax these items are still considered firearms and all of the shipping rules that would apply to a standard rifle, pistol, or shotgun still apply to your AOW-- only ship to an FFL or C&R holder if the firearm happend to be a Curio and Relic.
You cannot ship the firearm directly to an individual, it must go to a dealer in his home state so the buyer in this case will have to locate a Class 3 dealer near him to receive the firearm from you. When the buyer provides you with a copy of his approved Form 4 showing the firearm removed from your name and registered to him you may ship the firearm to his dealer. Individual Form 4 approvals can take months so I prefer to get the money from the buyer up front and charge a 20% fee if the BATFE approval falls through. As the seller you have to do nothing more than provide some information (make, model, serial number) to the buyer and wait for the go ahead from the BATFE to make the transfer.
