Can someone tell me if I were to buy a gun for my wife, would it matter if I had the background check done instead of my wife.

  yes it matters you must be the one purchasing the gun and fill out the paperwork in the store then they call in an instant check while you wait. if you want to buy this gun as a gift the best thing to do is buy it registered in your name , give it to her , then go and get the registration transfered,most gun stores will transfer the gun from your name to hers for around 5 dollars. also before they transfer the gun she will have to pass the check

  You wouldn't by chance be the "teufuelhund" who has helped me with M1A/M14 questions would you @ C.C. would you?
  
  If so,..nice to see you,..and to answer your question, that would be a straw purchase,..unless the gun is in your name and she just "uses" it.
  
  why chase the game when the bullet can get em from here?....

  When you go to buy it. DO NOT SAY, " It's for my wife " Depends on the dealer, He could say it's a straw purchase. The less paper work you can do with any info going to the Feds, is good idea. Just keep the gun in your name [^]

  Get yourself a copy of the Form 4473, go to IMPORTANT NOTICES #1. It states that for purposes of this form, you are the actual buyer if you are puchasing the firearm for yourself or otherwise acquiring the firearm for yourself (redeeming the firearm from pawn/consignment). You are also the actual buyer if you are acquiring the firearm as a legitimate gift for a third party.
  As long as the third party (your wife) has no disabilities (reasons why she cannot own/receive a firearm) there is nothing wrong with you purchasing a firearm for her under federal regulations. The "straw purchase" only comes into play when the buyer knows that he/she is purchasing a firearm for someone who cannot legally own/receive a firearm.

  Hey teufuelhunden! Who's to say that you aren't really buying the gun for yourself. I think you are really the one that wants the gun. Let's say that you take it out and fire it once and low and behold it just isn't exactly what you want. In your thinking about how you probably shouldn't have bought the gun, it dawns on you that your wife needs a gun and it would be perfect for her. So you clean it and put it back in the box and rap up a "used" gun to give as a present to your wife. Problem solved. Of course this is just one of the many factual events that could occur to any one of us. Ever bought something and it wasn't all that you thought it would be?[;)]

  It is legal to give any gun from father to son or husband to wife or vise-versa unless there is a state law were you live that says you can't.
