Post Ban Hi-Cap?
I was offered a 30 round AR-15 type magazine by a friend today and I was wondering if it was legal for private ownership. Apparently my friend got it from his brother-in-law who was a Sgt. in the Army. Again, it is a 30-rnd mag, black follower, with the following markings on the floor plate:

A relative of mine that I talked to said it may be made post ban for military or LE use only and may be illegal to privately possess. Any help is appreciated.

It should be marked "LE or export only" if it's post ban. Being a military contract mag it may not. If it ain't labeled I wouldn't worry about it.

A typcial restricted post ban M16/AR-15 magazine would be marked like this (from a Colt 20 rd magazine-- right side): RESTRICTED MILITARY/GOV'T/LAW ENFORCEMENT/EXPORT USE ONLY. (left side): COLT'S MFG. HARTFORD. CT. MFG 3-98. A magazine marked in this manner is a post ban magazine and may only be possesed by those listed in the stated restrictions or FFL licensed dealers. Any magazine not clearly marked as restricted is not considered restricted unless it can be PROVEN other wise. While I agree with Joey's take on the issue of legality, if the magazine was stolen from Uncle Sam this is a matter beyond the scope of the 1994 Crime Bill.

Mark, I agree 100% if the magazine has been stolen from Uncle Sam, it is a different issue, but now that brings up another question. People are advertising and selling USGI mags on GB and gun shows all over. Can you get them legitimately somehow, or have they all been ripped off from the government?0 -
Have had Hundreds of the U.S. Military Mags, KAY, CenterArms, Colt, PWA, Sanchaz, etc. The Least of my worrys is: Someone ripping off the U.S. Military or the U.S. Government. Fact is: U R In the South, Liberals are at a Minimum at this time, so: If it doesn't say "Law Inforcement" carry on trooper.

Gosh, all I wanted was a simple answer to how all the US military mags get to be sold as surplus, not a soap box tongue lashing or some dose of someones reality that may not match mine!
It is still a legitimate question. How do all the surplus mags get on the market. Are they all really stolen?

cdm, you are correct, it was a simple question & deserves a simple answer.
The mags you have seen are not USGI surplus; the armed services have no reason to sell new mags when they are currently buying them for their own use. However, with M16 mags just like the M14 mags before them, the manufacturers sold the same mags to their distributors for sale to police and (when legal) to civilians. Why wouldn't they? Until the high cap ban, this was perfectly legal.

Had to mention, not all post ban mages are clearly marked, those from Center Industries are only marked with the date of manufacture (months and year), they are not marked LEO or Military use only. Be careful buying Center Indusrties magazines, they are not clearly marked, and are being sold openly at gunshows.
