preban?
How do I tell if my SKS is preban? I bought a folding stock for it a couple months ago. On an other thread it was brought to my attention that only prebans that came with a folding stock can leaglely have one. If this is true, can I just put the locking pin in to keep it from folding, therefore keeping it leagal?

Bayo lugs are a good indicator, but some postbans came in with lugs sans bayos so that doesn't always work either[B)]

You can replace an existing folding stock on a pre-ban,however, I think it is illegal to put a new folding stock on any SKS that does not already have one on it. I could be wrong though. 0 -

There is a strange restriction on Hi-Cap/Detachable mags I have heard of regarding SKS's...at least in the Land of Lincoln (IL). To the best of my knowlege/recollection, these mags are only allowed/legal on these if you can prove ownership of the rifle since 19??, regardless of whether it is pre 9/94 production or not. The bayo lugs I'm not sure about. I have seen recent sales of these in Yugo and Russian w/bayonets, but had been informed earlier by a dealer that sporting a bayonet on them was illegal. This particular dealer had removed the bayonets on receipt from the distributor and was selling them seperately. I can only say that the magazine restrictions seemed to be very odd/bizarre, and I am not clear at all on what the bayonet issue is. I will have say the collapsible stock concerns me too and would also be worth looking into elsewhere if your not satisfied w/the answers you get here.
Web-searches are a great source for info. There are probably several good web-sites dedicated to the SKS. Some of these locations can be helpful if you don't get what you need here. Someone may post here eventually with a comprehensive and accurate reply, but until, then...try a search on "google" for an "sks" site. I would also be interested in what may develop regarding this inquiry since it has been a bit of an enigma to me also. Try the NRA site for state laws also. The "advanced" search on www.google.com works pretty well, just enter the pertinent info regarding your particular interest/concern. Google is just a suggestion. You may have better luck elsewhere.0 -
Putting a Folding Stock on your SKS automatically means: "You are a Rebellious Trouble Maker", "A Militia Trouble Maker", or Intending to Shoot your Girl Friend, Rob a Bank, or are a Mental Retard".
My Suggestion: Get a Hand-Grenade with a Bayonet Lug. That would net you about 20 years in the Federal Pokey or Shot on Sight, by the Infamous BATF! [:o)]

Even if it's a post-ban, September 2004 you may be able to install the stock as their may no longer be pre-post ban firearms.

Fort Knox, not as though it would mean anything to him, but the dealer who is removing the bayonets from the soviet block SKS rifles he is selling is not aware of the law, unless he is doing it for local/state reasons. The soviet block SKS qualifies as a curio and relic and is exempt from a bayonet prohibition. In fact, the only law restricting bayonets on an SKS pertains to chinese rifles.
I believe it was around September of 1989 when it became illegal to modify the SKS to accept detatchable magazines. Maybe October or November, 1989. It was the 1989 ban that affected the SKS, because the SKS was never really an "assault rifle" the only way the 1994 ban would apply is restricting the addition of assault weapons features.
Nitrous, the sunset of the 1994 ban will not affect the modification laws to the imported SKS in any way, since it wasn't the 1994 ban that restricted the modification. I suspect that, if the ban does sunset, you would have to add several US made parts to be able to classifiy it as a US made rifle, and then maybe it would be legal to modify it.
From that date on, it became illegal to modify the SKS to accept detatchable magazines UNLESS the bayonet lug was removed. Also, you couldn't install a folding stock.

I had heard the info on the detachable/Hi-cap mags before, but it was so long ago I forgot the details (year).
You are legal with the mags if you are able to prove ownership of the pre-89 since that year aren't you? That is what struck me as bizarre about these. Usually a pre-ban can be modified because it is a pre-ban...regardless of how long you have been the owner. Perhaps it isn't a "pre-ban" via. 94', but it would seem the concept would be similar...do as you wish as long as it isn't post 89'.
The bayonets this dealer was removing were Chinese...and that was a several years ago. That jibes! I was not aware of the special status the Soviet Block era SKS's had regarding bayonets. That would explain that.

I don't know what it's like in other states, but here in Kansas, the simple fact is, no one, not even law officers, seem to care one bit about the 1989 and 1994 bans and what it meant. At gunshows, there are SKS rifles with folding stocks and those duckbill aftermarket detatchable magazines at table after table, no one cares. People check their weapons with sherriff's officers at the door, as a safety check, and many of these are illegally modified rifles. They just don't seem to care about SKS rifles that have been fitted with detatchable magazines, folding stocks, and bayonets. I've seen plenty of other illegally modified rifles openly displayed at gunshows, such as Chicom M14S with flash hiders and bayonet lugs.
I think it's significant to note that there has not been one conviction of Section 922(R) since the law was enacted. I think much of that is, law officers realize the near impossibility of effectively enforcing the laws. Maybe some day that will change, but I think the only thing they might be using those laws for now is bargaining chips in plea bargain agreements. That is, some drug dealer gets caught with an illegally modified weapon, they drop the charges on the assualt weapons violations if he agrees to plea duilty to selling drugs and using a fiream during the commission of a felony, may they use it for that sort of thing. They sure aren't enforing the law on 99.999% of everyone who modifies their SKS.
Don't misunderstand me, I'm not at all suggesting anyone committ a felont and modify their SKS. I follow all applicable laws myself, just because I don't want to be the first test case, or second for that matter. As far as I am concerned, the SKS works best in it's original configuration anyway. It is a very effective rifles in it's original configuration, why try to mprove on something so nearly perfect anyway?

(the ones that make them) And when the Laws CHANGE (which they often do) Perhaps they will inform you as WHAT TO GIT RID OF? Please do not feel as if you are bothersome; This is what we Pay them for.
