Hercules 410 Pen gun (Identification Please)
We have a customer who inherited a Hercules Mod. 40 410 Ga. pen gun. This gun looks about the same size as a mini mag light with out the head. It is anadized blue in color and still functions. The lil thing looks to be about 90%. The owner states his father bought it new around 50 years ago. We can't find it in any book. Does this gun posses any value? If so, how much? Is this gun in violation of any Federal law by standards of BATF? View points and opinions greatly appreciated. Pictures available upon reguest. We took pictures before the owner left the shop. blackgun101@yahoo.com

No view point, no opinion. If that little darling wasn't registered in the mid 60's, it's about as illegal as anything you could put your hands on.
Value is zero to minus $10,000.00 with a federal vacation included. What you decide to do with this piece is up to you. All I know is that the sooner it disappears, the better.

I believe this is one of the devices covered in Swearengen's Book ( World's Fighting Shotguns ). Was originally made to fire a tear gas shell. These type of devices used conventional shotgun shells or cartridge cases, loaded with a tear gas payload, not projectiles.
They were available as late as the 1960's before the fed's and local law enforcement started cracking down and stopped their manufacture and sale.0 -
Hi Steve,
I would say it is in violation of the NFA

Picked up the following add off one of the on-line auctions. Apparently this individual, has no reservations about the legality of the tear gas launcher, as he's selling it on the net.
Perhaps some of the previous posters should contact him and inform him how illegal this device is, to keep him out of trouble.
