ItGoBang, perhaps you are tired of hearing from me but here is the answer to your question. Like anything else in California this is way more complicated than it needs to be but people can get into trouble if they don't understand the law. PENAL CODE section 468 prohibits what is called a "sniperscope". This is an optical device made or adapted for use on a firearm which allows the shooter to view or detect objects during night time through the use of a PROJECTED LIGHT SOURCE (my own bold type added) and an electronic telescope.
What this means is that you cannot have an active infrared "snooper scope" (as v35 like to call them) which can be mounted on a firearm and used as a gun sighting device. You can own PASSIVE "starlight" optical sighting devices and you can own infrared devices if they cannot be mounted on a firearm. As usual there are a few narrow exceptions to the IR scope regulations (just like for machineguns, assault weapons, and switchblade knives) for a privilaged few in this state and I own an ELTRO-ZEISS unit which mounts on an HK G3 rifle. These IR units are, as a rule, so large and bulky that few people outside of collectors are even interested in them and much prefer the newer and lighter passive devices. I hope this answered your question.
