    I think the answer is that it depends upon the state. If I pay the out-of-state dealer, I only pay a transfer fee to my ffl. I believe some states require collecting tax on interstate transactions.

    Get a different FFL in CA. Unless it changed on Jan. 1, not all the FFL's are chargeing state sales tax in CA for FFL transfers.

    THE CA DEALER IS ACTING AS THE AGENT FOR THE BUYER AND MUST CHARGE SALES TAX. IN MOST STATES WITH SALES TAX YOU ARE SUPPOSED TO REPORT ANY OUT OF STATE PURCHASES ON YOUR TAX RETURN AND PAY SALES TAX TO YOUR STATE ON THOSE PURCHASES.

    My FFL dealer said once that he had to charge tax as the package was addressed to him and he therefore owned the gun and had to charge tax even though it was for me. He said in the future, make sure packages sent to him say, "Jonathan Klein, c/o Mike Daubner" instead of just his name.

    When I do a transfer for someone, I send the FFL and tell them to send the money. They will pay the tax on their state income tax return. If they give me the money to send with the FFL, I am bound to charge state sales tax because I have become a purchasing agent. Tax evasion is illegal, tax avoidance is not.

    Sometime ago this same question was asked. I sent an E-Mail to the Franchise tax board & recieved their reply which I posted on this site. They said the dealer is not suppossed to charge Sales Tax on such purchases. They also stated that the buyer is suppossed to report such purchases & pay the Use Tax. (I wonder if anyone has ever done that?)

    he he he ....yea I send 100s off to sombody I dont know 1/2 way across the country, then I pay those shipping charges, and a fee to my ffl dealer, more for a backround check , all on a gun that I bought after looking at a blurry picture on the internet and reading a discription by a guy that is just interested in making money. And if all goes right Im still supposed to pay state taxes ...yea right

    In my state [FL] the value of a trade in is not taxable . If you trade a nice $800 USA Mag. for a $800 weapon , no tax .

    In my state(NJ) I only charge the transfer fee to my customers who recieve a gun from the internet, because they didn`t buy it from me, there for I can not charge him/her sales tax, nor if an out-of-stater buys a firearm from my website I can not charge them NJ sales tax, cause they don`t live in NJ

    Check old posts on this topic. We had a lengthy discussion a few weeks ago. It seems that it varies from state to state. Personally, I think the answer is no. I can see possibly paying sales tax on the cost of the dealer service (probably % of around $25.) but that's it. I could be wrong again - just ask my wife!
