Shipping to a Expired FFL

I am a FFL and I recently sold a gun on gunbroker.com when I received the FFL from the dealer that will be receiving the gun it was expired as of May 1 2003.My question is can I still ship to the FFL? It says in the BATF Federal Firearms Regulations Refrence Guide that you can ship to the FFL no more than 45 days after the date it expires.But when I verify the license on the ATF website it says that I will also need a Letter of Continuing Authorization.But again in the regulation book it say that the FFL does not need to send any other proof untill the 45 days have passed so I am stumped.Any help would be appriciated.

It has been explained to me that receiving the copy of the FFL is to verify that the delivery is made to a valid dealer. If you are reasonably sure of the dealer's validity (like when sending a gun back to the manufacturer) then ship it. If not sure, I would use caution. I would contact the FFL and ask about the situation. The buyer may want to make other arrangements.

This is a tough call. The regulations allow a dealer to continue in business as long has he has applied to renew his FFL. In my case, my FFL expired on 01 April, 2003 and I had renewed back in January. Come April first there was no new FFL in my PO box, so I asked for a letter of extention from the National Licensing Center in Atlanta and received one- it took three days with an e-mail request. Five days ago my new FFL arrived so all is well. You really have no way of knowing whether or not this dealer did in fact renew his license. I would hold out for an extention letter from him that indicates he has renewed and is authorized to continue operating...but this is only my opinion and I prefer to play it safe.
