FFL Information

Howdy, I have been considering applying for an FFL so I can have a small business from my home. I don't anticipate selling a lot of firearms but figure that I will sell a dozen or so a year. My question is this. Do you guys know what the requirements are for personal firearms? I know that an FFL is not to be used to build a personal collection. Are there a certain number of firearms one must sell for every one they buy for themselves? I.E., a certain ratio like 3/1 or 10/1?

Second question, I have spoken with my local law enforcement officials and they are aware of my interest. I think I have everything that I need to send in my application. Is there any advice that you would give to a new FFL holder?

    If you bought 300 guns, and golly looky here- your license expired. The guns can not be sold.

    Let's change the laws and quit bickering about them. One man CAN change the status quo.

    Snake-eyes,I'm not saying you're wrong.But where did you get that information ?
    Are you an FFL ? I am ,and have been one for 12 yrs.and never heard that one.What would you do with your inventory ? Take it to the nearest Police Station ???

    ATF ditto on your comment to Snake-eyes, for some reason the crap house lawyers that do not have an FFL put out more dumb statements and wonder why FFL holders get a royal case of the butt at them. I read on this forum about how the FFL holders should receive and ship firearms, how they should or should not charge a fee, how they should or should not charge ales tax and on and on. Dustyhol---if you want information on applying for an FFL you can order the forms from the ATF publication center, you will also need to check your city zoning code and with the state that you reside in if you need a sales tax resale number, also if a special license is needed for the city, county or state. Last but not least talk to a good tax attorney. Good luck

    dkf gave you great advice.

    To answer your question, BATF does not have "number requirements" for the sale of firearms by FFLs. They definitely don't care how many guns are in your personal collection. However, they expect you to conduct business in a professional manner. If they believe that you are just trying to get guns for yourself & your buddies at wholesale, they'll revoke your license.

    Just a note to add a little to what the others have said. Zoning is especially important to check on. Go by your local zoning office and see if they will allow to to use your home for the business. If they will you shouldn't have much to worry about. Check on your business license and call about your state tax. Also you must have a secure storage for the firearms. Hope we were able to help.

    Hi all...

    I`m an FFL dealer/Gunsmith in NJ, and have bin one for 8 years and just one more note to add...once a year the State and ATF come to inspect you shop,store what ever you have and they check your log books to see where the firearms were acquired from and who they were dispositioned too, also they check your 4473 forms and if they see that a lot of the firearms were dispositioned to you they may take that as you trying to make a personal gain for your own collection,an occasional firearm dispositioned to you is not a big deal, and one last note"You have to show intent of business" meaning that your in business to make money not for collecting.

    I've been FFL in Maine for the last 12 yrs come Sept.I have been visited by the BATF once,the first time I put in for a renewal.The other times I get just a phone call.I must have them convinced that I'm legitimate.

    I guess you do,cause in NJ they come once a year to inspect,maybe the laws are different up by you..

    Until 9/11, BATF had sufficient manpower (and motivation from Bill Clinton) to respond to politically motivated requests from state & local governments to reduce the availability of firearms by putting FFL holders in their jurisdictions out of business. Vest pocket dealers were the easiest targets, but some large gun shops in metropolitan areas were also victims. BATF tactics were as heavy-handed as necessary to get results that satisfied the local politicians. Those of you in enlightened jurisdictions got little attention from them.

    The last remaining gun shop in Baltimore City lost it's license 3 years ago; BATF claimed that since a large % of recovered guns had originally been sold by them, then the gun shop MUST have been making "straw purchases". (Of course, permitting a "straw purchase" is a felony; if they had any evidence of that, they would have arrested the gun shop owner.) The owner has spent > $400,000 in legal fees, and apparently will not get his license back. So, any action taken by BATF should be considered "final".

    Do not think that because George Bush is now president, your 2nd amendment rights are safe. BATF has not received instructions from him to make any change in the way that they harass law-abiding citizens.

    Thanks for all the advice. I am afraid that I am going to run into some zoning issues. I don't believe that I will be able to get a business license for my home address. From what y'all have told me I will need to have that in order to proceed with an FFL application. Oh well, I guess I will just have to move!
