Bid on New got USED???

I won an auction for a New handgun, and when it was shipped the pistol was definetly used. It has atleast 150+rds of powder left in it. What do I do now? The seller refuses to answer emails. After 30days I understand I can try the Fraud claim that Gunbroker offers to their members. The seller being an FFL also? I don't trust everyone but an Item listed new should be NEW! Right or Wrong? Well what would you do?

  I'd be pi$$ed.. give the seller a little time to see if he comes through, I wouldn't wait too long. if possible, re-read the auction and I know that sounds lame but make sure you understand it to the fullest for your benefit. then rake his a$$ over the coals.
  
  If it doesn't pan out for you, I would like to know the seller so I too can avoid them. I hope everything works out for you.
