shipping question
Can I with a C&R licence ship a C&R Hand Gun to an other C&R licence holder in an other state? I got a no from the ATF office in Philadelphia and a yes from another agent several days later.

I recently sold an item on GB'er and waited 7 days before receiving the payment. I shipped the Mid sized Priority mail box the same day I received payment. I used the address given on the GB'er sight, no other address was ever given me. The package has still not arrived and he contacted me and I told him when I shipped it and my receipt said he should have received the shipment 5-6 days ago. When he found out I had used the address on GB'er, he told me he had moved and forgot to changed his address on GB'er. He found out at his old Post Office it was being sent back to me. My question is, should he pay for me reshipping to him at his new and correct address or should I pay half or all the shipping? I want to be fair. What say ye? 0 -
To ship firearms, you would normally ship from your local FFL to the buyers FFL...
When I ship from my local FFL, I don't have to give them any info, just to whom it goes to and the FFL fee ($25 here).
One of the FFL holders can give you a more definitive answer...

You don't need to go through a FFL to send your firearm to a FFL. They may want your name and address but don't need your ssn. If I were you i would call the FFL you sent the firearm to and see whats up.

gmayes is correct. According to Federal Firearms Regulations Reference Guide (ATF P5300.4), all the receiving dealer needs is the sellers name & address OR FFL # to enter in the "Receipts" column of his bound book. As a matter of courtesy, I usually supply a photocopy of my drivers license, so that the receiving dealer can feel confident that he is entering valid data in his bound book. Do NOT give him your Social Security Number; legally, no one other than the Federal Govt can require that you give it (however, businesses & government may refuse to give you services or your paycheck if you choose not to do so.)
In your position, I'd just give him a copy of my drivers license; you have nothing to hide.

Today I went to four different gun shops (2 of which are listed in the gunbroker.com FFL finder) and all told me that they will only receive firearms from other FFLs. I looked on the ATF site and saw exactly where it states that a nonlicensee can ship to an FFL but didn't want to argue with the shop workers. Is this a common thing? Has anyone else had a problem with FFLs that will not accept shipment from a non-FFL? I couldn't find any state laws either so if anyone has used an FFL in Tampa, FL, please let me know which one. Actually, it's pretty common for gun shops to refuse to accept gun shipments from individuals. This practice is based on either greed, or ignorance of the law.
It's more common to find gun shops that refuse to accept the shipment of a new gun from another FFL or a distributor. They figure that they are protecting their own profit margin, since it represents one less gun that they could sell from stock. I could sympathize with them except for the fact that these same shops refuse to accept shipment of new or used guns that they don't have in stock and are unable to order; THAT'S greed.

I think it is also a fact that dealers are covering their own ass by not accepting from non FFL's. The gun business is not an easy one to run especially with the ever changing laws ,regulations etc. Sometimes better to be safe then sorry. One wrong move your sued, out of business and for what ? 0 -

Try this: Walk into your local shop with a Colt Python in a case, & tell the guy behind the counter that you hope to get $100 out of it. Watch how fast the $20 bills are laid on the counter!
When they get a gun in the mail, or from UPS, it doesn't matter if it came from an individual, another FFL, or a distributor. All they have to do is log it in their bound book with the required information, and stick it in the safe. If it made any difference to ATF, they would change the regs.

Not in NYS . If a person walks in with a handgun it better be registered to them on a NYS pistol permit. If it is then after about a half hour of paperwork,forms etc. you can make a deal. From your tone it seems to me you are not a big fan of FFL's. 0 -
I DON'T THINK IT'S A MATTER OF ANYONE BEING DOWN ON FFL HOLDERS. IT'S A MATTER OF THE FFL HOLDERS WANTING ANOTHER FFL HOLDER TO GET PAID FOR SHIPPING THE GUN TO HIM. THIS IS RIDICULOUS. WITH SHIPPING COSTS AS THEY ARE NOW THE GUN SELLER DOES NOT NEED TO ENDURE FURTHER COSTS BY USING AN FFL HOLDER TO SHIP AN ITEM. IT'S PERFECTLY LEGAL FOR THE SELLER TO SHIP, PROVIDED HE USES THE PROPER CARRIER FOR THE TYPE WEAPON HE IS SELLING. I HAVE PAID MY SHARE OF TRANSFER FEES FOR GUNS I HAVE PURCHASED, AND I HAVE NO PROBLEMS WITH SAVING THE TRANSFER COSTS BY SHIPPING MYSELF. 0 -
I too have had this problem with a local FFL dealer here in Alaska. He told me the way he reads the law the gun is required to be mailed from a FFL license. He admits the law is a bit unclear but explained to me he made this determination just to cover his own ass. (Can't blame him these days.) I just went down the street to the next FFL dealer, he was happy to have a gun shipped to him from an out of state individual with just a copy of his drivers license and a $25.00 fee. He felt the law stated he only had to have the shippers name and address logged and that a drivers license was the best proof. Pays to shop around, this second dealer eliminates the need for me to get another dealer involved who will of course charge a fee also. 0 -
My dealer has been in business for years. Still the laws change daily, and He tries not to break them. He received a pistol I won on GB, AND COULDN'T find the shipping FFL. He called me, asked if the shipper was a FFL, I said no, just an individual. He wouldn't release the pistol to me for several days, while I contacted seller, poured over the BATF Regs, and finnaly decided we didn't need FFL. I used same argument on him as if someone came in with the gun to sell to him, how could he buy it from non-FFL? He finnaly saw the light and let me have pistol. This is a good guy, receives a lot of guns for me, and not greedy, sometimes doesn't chage me for transfers. Give these dealers a break, their just trying to stay out of jail, and in business, most arn't greedy, they are gun lovers like us!!
