FFL and zoning
Hello all.
How much of a problem can zoning be in PA if I plan to get an FFL and buy and sell firearms over the internet or gunshows. I mean nobody's gonna by them at my house. Do I even have to notify the zoning board in that case?

if im not mistaken i dont think you can get an ffl for those puposes only
i think you have to have store hours to get an ffl

ATF will approve an application if the applicant:
Is 21 years or more of age;
Is not prohibited from shipping, transporting, receiving or possessing firearms or ammunition;
Has not willfully violated the GCA [Gun Control Act] or its regulations;
Has not willfully failed to disclose material information or willfully made false statements concerning material facts in connection with his application;
Has premises [which in most cases can be your home] for conducting business or collecting; and,
The applicant certifies that--
(1) the business to be conducted under the license is not prohibited by State or local law in the place where the licensed premise is located;
(2) within 30 days after the application is approved the business will comply with the requirements of State and local law applicable to the conduct of the business;
(3) the business will not be conducted under the license until the requirements of State and local law applicable to the business have been met; and,
(4) the applicant has sent or delivered a form to the chief law enforcement officer where the premises are located notifying the officer that the applicant intends to apply for a license.
(5) secure gun storage or safety devices will be available at any place in which firearms are sold under the license to persons who are not licensees ("secure gun storage or safety" defined in 18 U.S.C. 921 (a) (34) ) .

No one on this forum can answer that question for you, at least with the information that you have provided.
Zoning regulations are NOT enacted by the Commonwealth, but by your county and/or incorporated city or town. Whether or not you will have customers coming to your home is irrelevant; you must be getting the FFL for the purpose of establishing a business, and you cannot do that without a Federal EIN, state tax number, merchants permit, AND zoning approval (or evidence that you don't need zoning approval).
You must contact your county zoning office to determine the last requirement. If you don't, you can bet that the ATF agent assigned to your application certainly will.

I looked into applying for a FFL not to long ago, if you intend on only doing internet sales and gun shows, good luck, they dont like issuing license unless you have regular business hrs and a permanent office any more. At least that is what i understand. 0 -
It is true that you have to list store hours on your FFL application but that doesn't mean you have to sell to people that only come to your house.Your store housr can be the hours you will be there to place guns on the internet. As for zoning you will have to check with your zoning office because whether you have people coming to your house or not your house will be your place of business. Selling 40 guns to area residents or selling 40 guns through the internet is the same as far as I can tell.

I think alot of it has to do with your area. It seems aquiring an FFL here in southeast Texas isn't very hard at all. If you've got the money and meet the criteria, your good to go. The only stipulation that I've found is that they want you to have a secure location for storing your collection.
I feel sorry for the poor bastard who's trying to get and FFL in any of the liberal extremest states.0 -
I had an FFL for years, paid my taxes, etc. Then one day I got a call from the Dept of Lic & Permits. They did some checking and found out my subdivision had restrictive covenants and dis-allowed "any" commercial activity. I went and addressed the homeowners asso and got a waiver. Lic & Permits then said, commercial acitivties require lined and defined parking spaces in addition to the residential parking....
Bottom line, had to turn in my FFL as Md had a Revolver & Pistol Lic that went hand in glove with the FFL, if you transfered weapons, so "License by Regulation" cost me my FFL.0 -
Sounds like maybe a change in managment and political agenda to me. 0
