C & R Pistol Purchase

I am going to Texas (Round Rock) this afternoon to celebrate my father in law's birthday. While there, I am going to try to purchase a CZ 52. I have a C & R License, so there should be no trouble in buying it. Now, how do I get it back to California? I really don't want to go through the hassle of bringing in back on the plane. Can I send it to myself? If so, by which carrier? I obviously want to do this as inexpensively as possible, so any advice would be greatly appreciated.

    You can send it via UPS or FedEx. Both will require you to use next day delivery, so it can be expensive. Figure $20 or so.

    Or, you can declare the gun to the airline and it can go in your checked-through luggage. It must be in a locked container and no ammo can be with it.

    Now, I know that dealer-to-dealer transfers of handguns are legal under U.S. Postal regulations, but I don't know how that affects a C&R licensee. If you can legally use the USPS, the post office will give you a nice box. The size 1096L would work well for the gun you have in mind. Wrap it securely and seal the box. Make sure there is enough padding to eliminate rattle. You should also seal the box with tape. The supplied adhesive sometimes lets go in humid climates.

    I don't think that you can do it.

    Doesn't CA law require that handgun transfers go through a CA dealer? If so, a C&R won't do you any good. State & local laws take precedence over federal law, so a C&R won't do you any good, if that's the case.

    In any case, few people outside of CA understand CA gun laws, & most folks in other states just won't sell you any gun. Why take a chance on violation a law you don't understand?

    In addition, a C&R is NOT an FFL when USPS regulations are involved. USPS requires an FFL (or manufacturers license) on both ends.

    Trust me here, you are far better off just checking the pistol in with the airline (it is not that big of a deal) than attempting to wade through the CA C&R handgun regulations. Technically you cannot have the handgun shipped to anyone but a dealer licensed in this state who will then transfer it to you. As a C&R holder you can however purchase handguns out of state and return home with them, although you must register them with the DOJ within a 30 day period. Member EoD Guy understands the CA C&R regulations far better than anyone on these boards so maybe he will chime in on this. Just put the CZ on the plane and forget about shipping it home to yourself.

    You are correct, but you must also add the proviso that the gun is legal in the C&R's state. The only question is; are M52s California legal?

    Thanks guys. I guess I'll just buy a locking case and declare it to the airline when I check in.

    It is perfectly legal to bring the C&R handgun back with you. California law allow you to use your C&R license to pruchase handguns while out of state and to bring them back with you. You must register it with the DOJ within 5 days, not 30, using a special Cal DOJ form for C&R Collectors. The cost is $19.00 to register the handgun.

    DOJ still hasn't put the required form on their web site. You can call the Cal DOJ and they will mail you one or you can e-mail me your address and I'll send you one.

    The C&R is only good for guns 50 years old or older. Can you prove that the CZ52 that you are going to buy is that old?

    50 year old guns are just one catagory of C&R weapons. If the weapon , in this case,the CZ-52, is on the ATF approved list of curio and relics, (it is), then it is a C&R firearm. Many bicentennial commemoratives made in 1976 are on the list as well as Yugo SKS's which are well under 50 years old.

    California, where the pistol in question is going to [hopefully] end up, only recognizes as C&R those firearms which are 50 years of age or older, whether or not they appear on the BATFE C&R list. While age is indeed simply one criteria of a firearm being classified as C&R, in California it is the ONLY criteria and having the pistol simply appear on the C&R list (as the CZ-52 does) is irrelevent to bringing it into California.

    Once again I learned something I didn't know about California's crazy gun laws. Makes me even more thankful I live in the South. What makes the West coast such a desirable place to live? Jobs, weather, women, money???? We've got all that here too!
