Private sales across state lines

    I know handgun sales across state lines require ffl's. I don't know about long guns.

    Just about all transfers between unlicensed residents of different states have to be conducted through a licensed dealer.

    The Fedcoats would like to make ALL gun sales/transfers have to go through an FFL. But at present they haven't been able to extend their tentacles beyond requiring an FFL to FFL exchange between private parties in different states except in the case of handguns. The so-called legal reason for this requirement is that whenever you cross a state line you are engaged in "interstate commerce" and the Fedcoats claim at that point they can make any and all the requirements they chose to make on you.

    However, I am just a novice in this subject, so please wait until a truly knowledgeable person gives you an answer. [:)]

    Federal law only permits a nonlicensee to transfer a firearm to a nonlicensee within his state (where permitted by state/local law), or to an FFL in any state. It's best to get the law from Federal Firearms Regulations Reference Guide (ATF P5300.4).

    Yes, just about. There are exceptions, such as bequests from an estate.

    Sorry, but that's incorrect. The type of firearm doesn't matter. All interstate sales between unlicensed persons must be handled through an FFL

    All hand and long gun interstate firearms transactions must be via FFL holder per BATF regulations. I am FFL gunsmith and handle them on regular basis for internet sales, auctions, estate closings, even persons sending firearms to themselves from out state to home state.

    m.j. ryan I would have to disagree with the last part of your statement , i person whom legally owns his firearms does not need to use a FFL to ship them to himself in a different state ,

    Sorry,everyone I'm wrong (first time [:D])The law says a person can buy a long gun out of state from a licenced person in that another State.Again sorry.[:)]
