California FFL dealers, I have a question.
I work part time in a gunshop in Wyoming. I had a customer from California come into the store wanting to buy a Ruger Red Label shotgun. I had another customer in the store telling me that I could not sell this individual from California a firearm. There are no Wyoming laws prohibiting me from making the sale. We do an instant background check and if the customer passes the check, he can leave with the firearm. My question is, are there any California laws prohibiting a resident of your state from buying a rifle or shotgun out here in Wyoming?

Not an FFL, But If I recall Calif laws apply to Calif Residents who buy out of state. 10 day wait period. Don't take my word for it but I think thats how it works.

I don't think other states are required to obey Kali laws. I heard this somewhere else.
The back ground check is all that is required. If they ok it then it's legal. There is no federal law restricting it.0 -
I've heard of a california resident who bought a long gun from a dealer out of state recently. Don't believe there was any problem.
I've just spent several hours reading the California Codes about firearms, which are written to regulate sales and transfers, not receipt. That is, it's the seller/transferor who's breaking the law when it's not followed. There is no statute directly addressing carrying long guns in from out of state that I can see, though the intent of the law is clearly to record all sales pursuant to a background check.0 -
Chris, since you work in a gun shop, you need to be familiar with firearms regulations; the 2 books that you MUST be familiar with are Federal Firearms Regulations Reference Guide (ATF P5300.4) & Published Laws & Ordinances - Firearms (ATF P5300.5).
Federal law permits sale of a long gun on your premises to a resident of another state IF that sale is permitted by the laws of BOTH states. Now, I know that you know the law in YOUR state, but if the law in the buyer's state doesn't clearly state that the sale is legal, don't do it; if it's NOT legal, your employer could lose his license & you could wind up in a federal institution.
If in doubt, let your business owner make the decision.

The best thing to do is not sell anything to any California resident. They made their laws and if they don`t like them they should either get out of that lousy State or change them. I don`t sell very much but, there will be nothing going to The Republic Kalifornia because of their laws, I won`t take any chances with them. I am sure this is going to start a lot of screaming but, that is my opinion.[:)][:)] 0 -

California law requires that the transfer be completed by a California licensed firearms dealer. Since you must follow the laws of both Wyoming and Caifornia, you cannot directly transfer the firearm to him. It must be shipped to a California dealer for transfer. 0 -

Long story short, I asked the same question about a friend that bought a rifle over the counter in MT. So that tells me as a CA. Res., I can just drive to Nev. and buy over the counter.
Then I thought to myself, Self!
If that was leagal everyone would do it! Gotta be a Catch some were in there. That would just be to easy- [;)]

Chris, there are lots of restrictions by states, counties, & even cities. Some restrict all firearms, some restrict handguns, some restrict Class IIIs, & some restrict so-called assault weapons. You could write a book on it. (Actually, BATF DID; it's ATF P5300.5).
FrancF, as a CA resident, there's only one way that you can legally buy a gun in NV. You have to register as a full time student at a college there & rent a dorm room or apartment. Only problem is, you can't legally bring the gun back with you to CA.

Chris- I'm a lifelong Kali resident, as well as a former FFL holder.For what its worth, due to the countless regs -federal,state and local, I would NEVER ship or deliver to anyone other than an FFL for an out of state sale.Just to CYA!!!!EOD knows the laws.

Not quite. You can purchase any firearm that is legal in Kalif. & have it shipped to a FFL in Kalif. for pickup.0 -
California is wacky and anti-gun for sure, but on this particular question I'm still not convinced. State laws only apply while you're in the state. There's no statute I find that says you can't buy out of state, or bring a long gun into the state. The laws cover in-state transactions. Which CA statute would be violated by buying a long gun out of state? The same goes for the CA waiting period. The laws describe the obligations of the seller/transferror, not the buyer, so far as I see. Though after reading 70 pages of statutes covering just two firearms topics, my mind is jello... 0
