What is legal length for a collapsible stock ar-15

Is it measured from collapsed or extended?

Also do they make recoil pads for the collapsible stocks? My cousin wants to get a .308 AR-15 with collapsible stock, so I'm doing some checking for him.

  Mark: does it include the recoil pad or is it to the end of the stock itself ?

  i thought it was taken with the stock in its most retracted position??? anyways, on an ar15 that shoots .223(which has a shorter reciever than a .308) with a 16" barrel + reciever, the minimum stock length is somewhere around 2"-3" so pretty much any stock will do [8D]
