C&R Question
I've got a m-92 win. up for auction here (#46161756) that has been copletely rebuilt but to all original spec's. it this still c&r transferable. A potential bidder wants to know. thanks.

I just finished filling out my C&R renewal and was surprised to see question #8 ask my if I have, or planned to do any internet sales. It then went on to ask which site(s) I planned to use. I don't remember that last time, any idea as to when that appeared? 0 -
You do not have to use your licenses for face to face transfers, only the firearms you buy through an out of state dealer you must send a copy of the C&R license.

A C&R is a Class 03 FFL (versus an 01 that a dealer must have). As D@D stated, the only time you have to use your license is for all non face-to-face transfers. If you are purchasing a "modern" firearm, then it is a moot point regardless. Xerox copies of your original Class 03 FFL (C&R license) that are signed in blue or a color other than black ink is all that is required (certification is not required).

Although I agree with the procedure outlined by Bert, the regs don't actually SAY that you must sign the photocopy of your C&R in a color ink other than black; what they DO say is that the the photocopy must by signed in ink. Use of a different color makes it easier to be sure that the signature was signed after the photocopy was made.
You DO need to use your C&R photocopy when making face-to-face transfers if you are obtaining a firearm while outside of your home state; you will also need to show the transferor your drivers license. You should also be aware that all firearms transfers must comply with the laws of both states, if buying/selling a firearm out of state. So, if either state has laws more restrictive than federal law, that takes precedence.

So if that were true and you didn't need a copy of your license for in state face-to-face transfers, then how do I know that the person is a valid FFL holder. If I'm selling to another FFL I'm getting a copy of his license, no matter where he is from.

Being how I'm a C&R Collector I'm not a dealer so if I bought a firearm without my liecenes I can sell it locally without useing a my liecenes or going through a FFL dealer its legal to do here in Texas. If I used my liecenes to get the firearm when I sell it to up-grade my collection I must put who I sold it to in my bound book. If they don't have a FFL or C&R I can use their drivers liecenes. Now if I have to mail it even in my own state I must send it to an FFL or C&R dealer.Confused yet.

D@D but you would have to fill out a 4473 and get a NCICs check if you didn't use your license.

Not here in Texas I can buy a gun out of the newspaper or any private citizen and since the person is not a dealer their is no need for all the forms.

I'm glad this was cleared up, I think. Sounds like I'm not the only one with questions. To summarize, this is what I glean from my ATF paperwork and your kind comments.
1. If I purchase a C&R weapon out of state, whether it's face to face, or say via mail through Gunbroker, I have to either show my license (face to face, like a dealer at a local gunshow in a neighboring state) or mail a copy (non-certified, just signed in lets say blue ink) to the out of state person I'm purchasing from. Purchase must be documented in the C&R bound book I'm req'd to keep.
2. If I puchase a gun from Joe Blow out of the trading journal who isn't a dealer I don't have to show my license or submit a form 4473 (state and local laws apply). And I don't have to document the purchase in the C&R bound book.
3. If I purchase a weapon using my license and then sell it to someone in my state without a license, that transaction must be documented using the persons drivers license. If he is licensed as myself, I use his C&R license for the documentation.
4. If I sell a weapon I puchased without using my license (now I'm Joe Blow in the trading journal) I don't have to document the weapon's disposal in my C&R bound book.
Does my understanding sound correct to you guys? And I really appreciate your help, There is a lot of room for error just due to mis-understanding of the laws. I'm wanting to get a thorough handle on all the regulations before I make the first purchase using my license.0 -
