I have heard and read that this is the case in the USA. Is this causing and problems for anyone?

Here is the american definition of a destructive device....

Anything larger than one half inch would mean anything larger than .500 not .490

Hello gibbs505 After looking at you post I wonder if this would apply to a so called potatoe gun? it looks like it does not have to be proppeled buy gun powder to fall within this class. 0 -

Potato guns" or "spud guns" generally consist of sections of PVC plastic tubing and fittings and are designed to launch a muzzle-loaded potato (or other similar-size projectile) using hair spray or other aerosol vapor as a propellant. The propellant is ignited by means of a barbecue grill igniter or other similar ignition system.
Section 5845(f), Title 26, United States Code, regulates certain weapons as "destructive devices" which are subject to the registration and tax provisions of the National Firearms Act (NFA). Section 5845(f)(2) includes within the definition of "destructive device" any type of weapon which will or may be readily converted to expel a projectile by the action of an explosive or other propellant, the barrel of which has a bore of more than one-half inch in diameter. However, section 5845(f)(3) excludes from the definition of "destructive device" any device which is neither designed or redesigned for use as a weapon and any device, although originally designed for use as a weapon, which is redesigned for use as a signaling, pyrotechnic, line throwing, safety, or similar device. The definition of "destructive device" in the Gun Control Act (GCA), 18 U.S.C. Chapter 44, is identical to that in the NFA.
ATF has previously examined "potato guns" or "spud guns" as described above and has generally determined that such devices using potatoes as projectiles and used solely for recreational purposes are not weapons and do not meet the definition of "firearm" or "destructive device" in either the NFA or GCA. However, ATF has classified such devices as "firearms" and "destructive devices" if their design, construction, ammunition, actual use, or intended use indicate that they are weapons. For example, ATF has classified such devices as "firearms" and "destructive devices" if they are designed and used to expel flaming tennis balls.
Possession and use of "potato guns" or "spud guns" may be restricted under State laws and local ordinances. Further, any person intending to make, use, or transfer any such device must be aware that they have a potential for causing serious injury or damage.

Somewhere in all that ATF gobbel-te-gook, there is a exemption for "sporting" cartridges IE 600NE 577Snyder 577T-Rex 700NE etc. or Wildcats designes that have met the criteria and are approved as "sporting" cartridges IE the 600 OK 700HE etc.
Some guys like a mag full of lead, I still prefer one round to the head.0 -

Hello, I believe the .55 Boyes Anti Tank gun was ruled illegal by the ATF for this reason. They were rebored / rebarreled to .50 to keep them legal.

A few months ago New Jersey was on the verge of passing a law outlawing guns of .50 or more.
The muzzleloading guys started raising hell and got the legislative morons to back off.
Maybe this is the news that drifted north of our border.0 -
Talking to a gunsmith in Canada, what the situation is, Americans cannot sell, without a export permit, outside of the USA. I really don't understand it, but that is the situation.

Interesting side comment, when GCA68 was originally enacted, ATF was going require every cartridge over .50 to be registered as a destructive device. They called one of my mentors in ammo collecting to find out how many of these forms they would need to bring with them when they came to register his collection / inventory (he was the biggest mail order cartridge dealer in the world at the time). When he said "at least five thousand," they suddenly decided that this would not be necessary to meet the intent of the legislation. Near as he could tell, that one incident prevented at least one foolish implementing provision of the Act, as ATF figured - accurately - that his collection / inventory was only the the smallest ice cube on top of the berg. Why these people overlooked that there is more ammo than firearms in circulation, is beyond me.
