Do you pay sales tax at local gun shows?
If the seller is from out of state can you avoid paying the tax? Any input or looholes would be appreciated...Thanks

a lot of states are cracking down on loss of sales taxes at flea markets and GUN SHOWS!!! OHIO, KY, TN, just to name a few that i deal in. the dealer may not charge you, but the state my require him to pay!!! This sales tax collection movement my be going from state to state!!! WHAT STATE ARE YOU IN!!!! Dont get caught up in this mess, just over a few bucks!!! 0 -
If the seller is a dealer, he/she should be collecting sales tax. If the seller is not a dealer, the recent movement is to get them to report their income and pay sales tax, so they should be collecting it also.
I know of one ex-dealer who still collects sales tax and basically tells the state to go fly the ultimate kite... he just pockets the "tax" as extra profit. Hopefully, he'll get bit down the road.
Several sellers include the sales tax in the small stuff and report this at the end of the show. Or at least I do.....

In my gun show observations, a state rep would come around asking how much you had done in sales and collected the proper percentage on the spot. Dealers would confess to a token amount and pay it. The tax collector seemed happy and issued a receipt. He had collected from X number of sellers which proved he had been there and tried. 0 -

thus is my long standing point that gun shows arent gun shows any more. its just a bunch of retail shops relocated. its like having a gun mall. the purpose of gun shows was (in the old days) for dealers to sell low and in higher volume to make up for lost revenue from customers not coming to their storefront. tax was collected. business was good for all parties. over in the shadows were the private sellers. they sold their stuff with the intentions of geting rid of old family stuff, not to profit and make a living. when private sellers decided to go into volume sales without being legitimate, that is what hurt real sellers. if the privates just stayed where they belonged, all would have been ok. now everyone is being eyed for tax. the other problem is bad guys pray on the privates to get guns w/o papers. face it. money is money and a sale is a sale. that hurt everyone. so, now all guns must go thru a ffl. some shows dont allow parking lot tailgate sales anymore. batf prays on the locals just looking for a bust. all of which has given me a bad taste towards shows and i quit going and selling. i long for the tag sale days...which is just a pipe dream these days.

Depending on the state, some sales are tax exempt to out of state buyers with the premise that the product must be mailed to the state of the buyers residence. In other words you cannot take it with you. 0 -

This reminds me, was still working in the shop had a guy come in from out of state wanting to buy a gun and have it shipped to his FFL. Guy refused to pay sales tax. His reasoning was that he lived out of state and that we should just let him buy this gun with out paying taxes. I said no way, he started throwing a fit so I passed him on the owner. Owner told hey if you have a resellers tax certificate -- in the firearms industry he might be able to sell it to you with out tax but otherwise forget it.

It used to be that dealers could not sell at gun shows, the BATF Changed the rules back in the early 80's.
Every state has their own tax rules, in Mi, a sale is a sale, if you rent a table at a show, the promoter will give you a tax form to fill out if you don't have a re-sale license.

to prove a point...how many of you bought guns on gb and paid tax? i didnt. the point is...if youre from out of state you dont have to pay tax in the state it was auctioned. 0
