Question for NY FFL Dealers

Is either a NYC policemen's shield or a shield from a police agency in NY an acceptable example for this person to buy a long gun without having to do a NICS check . This purchase would be in NYS also. For example NYC policeman walks in your shop wants to buy a Ruger 10/22 , can he produce the shield and drivers license fill out form 4473 and then leave or do you still have to do a NICS check ? We know handgun licenses are OK within a 5 year period but Im talking shield here not permit.

    A handgun permit in NY gets you around a NICS check so my question is does a police shield work also ?

    When police shields contain the holder's name, address, DOB, color photo, & hologram of the issuing authority, they will probably be accepted as proof of identity.

    True, it can be used to establish identity, but it won't get you around the NICS requirement...

    nys permit still has to have a nics check done every five years to purchase....

    A cop ID doesn't take the place of NICS in Texas.

    A CHL does, though, for a CHL is only good for four years, and to meet the Federal requirements, the background check preparatory to issuance of the license can be no more than five years old.

    In Texas, a TCLEOSE card is a permanent license unless revoked, and usually does not bear an issue date.

    SO...back when Brady I was in effect, cops had to wait to get their guns and their buddies with CHLs got theirs today.

    Handgun permits issued later than 5 years fro mthe date of purchase are OK as long as you have a NICS check done and it accompanies the permit. For example I have a permit issued in 1990, I then had our county pistol clerk do a (NICS)background check on me and give me a white sheet the size of my permit that says I have been background checked from 8/17/04 to 8/17/09. I show my handgun permit plus the sheet with the check done and bingo I can buy any long gun - fill out the form and go. A NYC Shield shows name ,Dob, expiration date and a tax ID number and is what police buy their handguns with for duty. SO the consensus is that this shield will NOT get them around a call in for a long gun ?

    I don't think that you can go by concensus on gun laws.

    Sometimes changes in one section of law do not result in corresponding changes in others. For example, there is a provision of federal law that permits an LEO to buy a firearm from an FFL anywhere in the country & have it shipped directly to him; in addition to the Form 4473 data, he has to provide a chief-signed request on department letterhead saying that he can buy it. But, this reg was written before Brady; and, Brady doesn't tell if, or who, does an NCIC check under this circumstance.

    I think the prudent thing is to request a written opinion from BATFE.
