LEO's and Permits
I just read this http://www.atf.gov/press/fy04press/072704lawenfsafteyact.htm does this mean that know local LEO's no longer need apply for Concealed Weapons Permits? I read qualified as being tested, and pass. I know when I received my permit a couple years ago LEO's needed to apply (didn't have to pay as much) and have one to carry off duty, unless they had express consent of the local sheriff.

I dont know about Florida, but here in Calif we LEO's have never had to get a permit to carry. Our police ID cards are all we have ever needed. The Calif penal code specifically exempts Leo's from the laws prohibiting the carrying of concealed weapons.
The bill you read was to allow police officers from any state to carry in all the other states in the USA. Before there was a patchwork of laws that differed from state to state. Before this bill passed if I went through 5 different states on vacation I might encounter 5 different sets of laws governing my right to carry, now it is the same all over the country.

As I've interpreted the law, active LEO's can carry concealed any where in the USA.
Retired LEO's have the same rights, but they have to 'qualify' once a year with the same type pistol the department they retired from carry's.
I may be retiring Oct. 1, so I'm glad Bush signed the law. Also, I've been told sKerry flew back from his campaign trail to vote AGAINST the law.

Yea when you apply for a concealed permit in Florida there is a section devoted to LEO's their price for 5 yrs I believe is like 50 bucks vs. 117 for me for the first 5 then I believe it goes to like 60 to renew every 5 years. BUt if this bill allows other LEO's to carry in Florida from out of state then I am sure local LEO's will not require a permit now. 0 -

The bill signed by Bush simply makes it legal for USA cops to carry in any other state. In Florida they may still charge the cops a fee to get their permits in Florida.
In my opinion it is stupid to charge an LEO a fee to carry off duty.
What do they do when an officer has not bought a permit-- take his gun away everyday when he leaves work?

Well according to the ATF they don't make federal licenses for anyone, it goes in accordance with the state which some states have reciprical permits. But what about LEO's that don't carry guns such as Correctional Officers? Permits I think if necessary for public should be for all. *Except if a sheriff or police officer and is in his county/town/city, but should not be allowed to carry outside of this without a permit IMO. I have seen too many officers get in trouble in other counties, with public drunkeness, brandishing firearms. There should be a system I know it sucks but it educates the ignorant, as well as LEO's who believe they are the law and don't need to abide by it.
But as I said before sheriff deputies or Local law enforcement who carry a gun to work, should be allowed in my opinion to carry the gun off duty in their city/town/county because it does provide a sense of assurance and establishes a law enforcement presense which is well needed.0 -
So making offduty LEO's get a carry permit will stop the idiot ones from getting drunk and brandishing a gun? That seems to be what you're saying. How will making them get a permit stop that?
Any officer, in his working jurisdiction or not, is in a lot of trouble with IA if he does something stupid like that.
Just as whichever state it was that had the first concealed carry law, others followed. Some of the states reciprocate in recognizing each others carry permits. I think this LEO law will help to get more states to cooperate for the citizens too.

I have not seen this requirement published anywhere. The only qualifying part for retired LEO's is that they have 15 years service. As I have moved away from the occupied territory of Kalif, I will not be traveling back to qualify on a yearly basis. I have not gotten a local CCW just because I will not got through their course and pay their fees.

I just read the link to the bulletin. I believe that the "Qualifying" section is open to interpretation. For instance (in Kalif) retired LEOs have no requirement for qualifying quarterly or even annually. Additionally there is no requirement that their carry gun be listed. And must by law must be issued a CCW upon retirement.

In California, at least, a correctional officer becomes a "peace officer" when a prisoner has escaped from the institution at which he works. Additionally, a correctional officer transporting prisoners is also a peace officer and in both cases can carry concealed. New York City requires its police officers to carry off duty. Also NYC correctional officers can carry concealed. The city recognizes the danger of these guys running into one of their former prisoners from Rikers Island. I am shocked to hear that Florida LEOs have to buy a permit to carry off duty. I lived in West Palm Beach for a while and many municipalities allowed officers to take their patrol cars home each day. They were required to reimburse personal mileage, but at a very reasonable rate. The idea was to give the appearance of a larger police pressence. Given this intention, I can't imagine these guys were not expected to carry. In addition, the regular Florida CCW permit can not be used by private security personel in the course of their work. They need a different class of permit.0
