I have a 28 guage o/u and want to properly pattern this gun. How big of a circle should I make and how far away should I test fire my load into the circle for a good pattern shot?

    40 yards (12 gauge).

That is the standard, but it most just depends on what distance you need your pattern checked.
My bro-in-law wouldn't ever shoot a turkey past 25 yards (dunno why) so he optimized his turkey choke for 25 yards which was vastly different than one meant to be ideal at 40.

pattern is checked at the distance you want it to perform and using the choke you want to use at that distance. but, as a starting point, (unless told otherwise,) i pattern all my guns at 30yds into a 30" circle with the exact sight picture desired. (line of sight or figure 8.)

I agree with bobski. But as you change ammo the pattern will change. just as if you had changed your choke tube.
